Some non muslims wonder how Islam gives a woman half of what the man inherits. If men and women are equal in Islam, how does Islam give a woman half what man gets in inheritance. [Image]
When we study the rules of inheritance , we will conclude many facts : First, in thirty cases , a woman actually gets a share equal to a man’s share or even more.For instance , When someone dies and leaves a daughter a wife and a father. The daughter will take a half of the whole Estate, the wife will take the one eighth
The father will inherit one quarter. He is a man ,a daughter is a woman .Islam is not concerned about whether you are a man or a woman . Islam concerned to the degree of closeness to the deceased.
Second, if we ponder over the cases in which man take more a woman we will find objectively that four cases only. For example , when a person dies and leaves a son and a daughter.the son will take double of his sister . the Question is why Look at the financial responsibilities a man has in a Muslim society. He should pay a dowry.A woman will take a dowry from her husband. He has family expenses and family upkeep. She has not any obligatory financial responsibilities in her father’s house or in her husband’s house . she is voluntary spending.

وَاعْتَصِمُوا بِحَبْلِ اللَّهِ جَمِيعًا وَلَا تَفَرَّقُوا ۚ وَاذْكُرُوا نِعْمَتَ اللَّهِ عَلَيْكُمْ إِذْ كُنْتُمْ أَعْدَاءً فَأَلَّفَ بَيْنَ قُلُوبِكُمْ فَأَصْبَحْتُمْ بِنِعْمَتِهِ إِخْوَانًا وَكُنْتُمْ عَلَىٰ شَفَا حُفْرَةٍ مِنَ النَّارِ فَأَنْقَذَكُمْ مِنْهَا ۗ كَذَٰلِكَ يُبَيِّنُ اللَّهُ لَكُمْ آيَاتِهِ لَعَلَّكُمْ تَهْتَدُونَ (103)

A History of Faith Communities in Ottawa
Interfaith Ottawa Photo exhibit

The City of Ottawa and leaders of various faith communities in the City signed a Memorandum of Understanding in 2003. This gave birth to Interfaith Ottawa, an organization co-chaired by the Mayor of Ottawa and a faith community leader. The primary objective of the organization is to promote interfaith harmony and respect among all people in Ottawa.

Over the years, Interfaith Ottawa has undertaken several projects pursuant to its objectives. Its current project is a photographic exhibition entitled “A History of Faith Communities in Ottawa”.

The exhibition does not deal with matters relating to faith and beliefs. Instead, it concentrates on the evolution of various faith communities in the Nation’s Capital and consists primarily of historical photos.

The Mayor of Ottawa will open the Exhibition next week at Ben Franklin Place (Atrium), 101 Centrepointe Drive. It will be open to public until June 7, 2010. There is no entrance fee for the visitors.

Members of ten faith communities are participating in this Exhibition. The City of Ottawa has provided space at the Atrium free of cost. However, each community paid a sum of $500.00 to defray other costs of mounting the Exhibition. The participating faith communities and Interfaith Ottawa will each have a separate panel.

The Ottawa Muslim Association contributed $500.00 for the Muslim panel. It will include a picture of the Ottawa mosque, along with one of the old house which was used as a temporary prayer facility before it was replaced by the mosque. There are photographs pictures of two Muslim Schools in Ottawa. Of particular interest will also be two individual photographs. These are of Imam Taufik Shaheen and Sister Eva Wahab. They served the Muslims of Ottawa with love, dedication and humility to their last breath. May Allah SWT make their abode in paradise.

The City’s panel include two pictures of special interest. The first shows Imam Gamal Sulaiman signing the Memorandum of Understanding. The second one shows the planting of a tree at the City. Each of the faith communities contributed something towards its planting. The Muslim contribution was in the form of a small bottle of water from Zamzam, poured at its roots at the time of planting.

Sister Safaa Fouda and Brothers Zohair Hassan and Farid Ahmed spent many hours and much effort to bring this event to fruition.

السلام عليكم ورحمة الله

هل يجوز تقبيل القران أو المصحف ؟

نقل بعض الاخوة فتوي فضيلة العلامة الشيخ محمد بن عثيمين رحمه الله تعالى ببدعية تقبيل المصحف وفي المسالة تفصيل احببت ان انوه عليه عسى الله ان يهدينا الى ما يحبه ويرضاه.:
نص كلام شيخنا كما نقله الاخ الكريم :
الصحيح أنه بدعة، وأنه ينهى عن ذلك، لأن التقبيل بغير ما ورد به النص على وجه التعبد به بدعة ينهى عنه.
هذا هو الصحيح عند شيخنا رحمة الله عليه
ولكن المسألة محل خلاف بين العلماء وهي مسالة اجتهادية واليك بعض من اقوال اهل العلم
فتوى لسماحة الشيخ عبد العزيز بن باز رحمه الله من فتاوى مجلة الدعوة العدد:1643
هل يجوز تقبيل القران؟
الجواب: لا حرج في ذلك لكن تركه أفضل لعدم الدليل، وان قبله فلا بأس. وقد روي عن عكرمة بن أبي جهل رضي الله عنة أنه كان يقبله ويقول. هذا كلام ربي "، لكن هذا لا يحفظ عن غيره من الصحابة ولا عن النبي صلى الله عليه وسلم، وفي روايته نظر، لكن لو قبله من باب التعظيم والمحبة لا بأس، ولكن ترك ذلك أولى.

السؤال : ما حكم تقبيل المصحف خصوصاً عند السادة الحنابلة ؟
الجواب :
المشهور عند الفقهاء : شرعيةُ ذلك، نَصَّ عليه الحنابلة ـ كما في : "كشاف القناع") ـ وغيرهم.
وفي ذلك يقول البدر الزركشي رحمه الله تعالى كما في : "البرهان في علوم القرآن") : "ويُسْتحب تقبيل المصحف؛ لأن عكرمة بن أبي جهل كان يُقَبِّله، وبالقياس على تقبيل الحجر الأسود؛ ولأنه هدية لعباده فَشُرِع تقبيله كما يُسْتَحب تقبيل الولد الصغير. وعن أحمد ثلاث روايات: الجواز، والاستحباب، والتَّوقُّف وإن كان فيه رِفْعة وإكرام؛ لأنه لا يَدْخُله قياس؛ ولهذا قال عمر في الحَجَر: لولا أني رأيت رسول الله صلى الله عليه وسلم يُقَبِّلك ما قَبَّلْتُك" أ.هـ. والله أعلم .
وقال النووي في ( التبيان في آداب حملة القرآن ) ص98 :
" ويستحب أن يقوم للمصحف إذا قدم به عليه لأن القيام مستحب للفضلاء من العلماء والأخيار فالمصحف أولى وقد قررت دلائل استحباب القيام في الجزء الذي جمعته فيه وروينا في مسند الدارمي بإسناد صحيح عن ابن أبي مليكة أن عكرمة بن أبي جهل رضي الله عنه كان يضع المصحف على وجهه ويقول كتاب ربي كتاب ربي " .ا.هـ
قال الزركشى فى البرهان
مسألة فى أحكام تتعلق باحترام المصحف وتبجيله ويستحب تطييب المصحف وجعله على كرسى
ويجوز تحليته بالفضة إكراما له على الصحيح روى البيهقى بسنده إلى الوليد بن مسلم قال سألت مالكا عن تفضيض المصاحف فأخرج إلينا مصحفا فقال حدثنى أبى عن جدى أنهم جمعوا القرآن فى عهد عثمان رضى الله عنه وأنهم فضضوا المصاحف على هذا ونحوه وأما بالذهب فالأصح يباح للمرأة دون الرجل وخص بعضهم الجواز بنفس المصحف دون علاقته المنفصلة عنه والأظهر التسوية ويحرم توسد المصحف وغيره من كتب العلم لأن فيه إذلالا وامتهانا وكذلك مد الرجلين إلى شىء من القرآن أو كتب العلم ويستحب تقبيل المصحف لأن عكرمة بن أبى جهل كان يقبله وبالقياس على تقبيل الحجر الأسود ولأنه هدية لعباده فشرع تقبيله كما يستحب تقبيل الولد الصغير وعن أحمد ثلاث روايات الجواز والاستحباب والتوقف وإن كان فيه رفعة وإكرام لأنه لا يدخله قياس ولهذا قال عمر فى الحجر لولا أنى رأيت رسول الله صلى الله عليه وسلم يقبلك ما قبلتك

وقال الحافظ فى الفتح 3/475
واستحب بعضهم تقبيل الركن اليماني أيضا فائدة أخرى استنبط بعضهم من مشروعية تقبيل الأركان جواز تقبيل كل من يستحق التعظيم من آدمي وغيره فأما تقبيل يد الآدمي فيأتي في كتاب الأدب وأما غيره فنقل عن الإمام أحمد أنه سئل عن تقبيل منبر النبي صلى الله عليه وسلم وتقبيل قبره فلم ير به بأسا واستبعد بعض أتباعه صحة ذلك ونقل عن بن أبي الصيف اليماني أحد علماء مكة من الشافعية جواز تقبيل المصحف وأجزاء الحديث

مسألة تقبيل المصحف أجابت اللجنة الدائمة للإفتاء عن سؤال وُجّه إليها حول الموضوع بالفتوى التالية :
لا نعلم لتقبيل الرجل القرآن أصلا . وفي جواب آخر : لا نعلم دليلا على مشروعية تقبيل القرآن الكريم وهو أنزل لتلاوته وتدبره وتعظيمه والعمل به . فتاوى اللجنة الدائمة (رقم4172) .

وجاء في الآداب الشرعية ( 2/273 ط. الرسالة ) لابن مفلح ما نصه :
وعنه ( أي جاء عن الإمام أحمد ) التوقف فيه (أي في تقبيل المصحف) وفي جَعْلِه على عينيه . قال القاضي في الجامع الكبير : إنما توقف عن ذلك وإن كان فيه رفعة وإكرام لأن ما طريقه القُرَب إذا لم يكن للقياس فيه مدخل لا يُستحب فعله وإن كان فيه تعظيم إلا بتوقيف ألا ترى أن عمر لما رأى الحجر قال : لا تضر ولا تنفع ولولا أن رسول الله صلى الله عليه وسلم قبَّلك ما قبَّلتُك .ا.هـ. رواه البخاري (1597) ومسلم (1270).

ما حكم تقبيل المصحف ؟ للعلامة الألباني رحمه الله
الجواب : هذا مما يدخل – في اعتقادنا – في عموم الأحاديث التي منها ( إياكم ومحدثات الأمور , فإن كل محدثة بدعة , وكل بدعة ضلالة )(1) , وفي حديث آخر ( كل ضلالة في النار )(2) , فكثير من الناس لهم موقف خاص من مثل هذه الجزئية , يقولون : وماذا في ذلك ؟! ما هو إلا إظهار تبجيل وتعظيم القران , ونحن نقول صدقتم ليس فيه إلا تبجيل وتعظيم القران الكريم ! ولكن تُرى هل هذا التبجيل والتعظيم كان خافياً على الجيل الأول -وهم صحابة الرسول صلى الله عليه وسلم- وكذلك أتباعهم وكذلك أتباع التابعين من بعدهم ؟ لا شك أن الجواب سيكون كمال قال علماء السلف : لو كان خيراُ لسبقونا إليه .
هذا شيء , والشيء الآخر : هل الأصل في تقبيل شيء ما الجواز أم الأصل المنع ؟
هنا لا بد من إيراد الحديث الذي أخرجه الشيخان في صحيحهما ليتذكر من شاء أن يتذكر , ويعرف بُعد المسلمين اليوم عن سلفهم الصالح , وعن فقههم , وعن معالجتهم للأمور التي قد تحدث لهم .
ذاك الحديث هو : عن عباس بن ربيعة قال : رأيت عمر بن الخطاب رضي الله عنه يُقبل الحجر ( يعني : الأسود ) ويقول ( إني لأعلم أنك حجر لا تضر ولا تنفع , فلولا أني رأيت رسول الله صلى الله عليه وسلم يُقبلك ما قبلتُك )(3) , وما معنى هذا الكلام من هذا الفاروق : لولا أني رأيت رسول الله صلى الله عليه وسلم يُقبلك ما قبلتك ؟! . إذاً , لماذا قبل عمرُ الحجر الأسود , وهو كما جاء في الحديث الصحيح ( الحجر الأسود من الجنة )(4) ؟! فهل قبله بفلسفة صادرة منه , ليقول كما قال القائل بالنسبة لمسألة السائل : إن هذا كلام الله ونحن نقبله ؟! هل يقول عمر : هذا حجر أثر من آثار الجنة التي وُعد المتقون فأنا أُقبله , ولست بحاجة إلى نص عن رسول الله صلى الله عليه وسلم ليبين لي مشروعية تقبيله ؟! أم يعاملُ هذه المسألة الجزئية كما يريد أن يقول بعض الناس اليوم بالمنطق الذي نحن ندعو إليه , ونسميه بالمنطق السلفي , وهو الإخلاص في اتباع الرسول عليه الصلاة والسلام , ومن استن بسنته إلى يوم القيامة ؟ هكذا كان موقف عمر , فيقول : لولا أني رأيت رسول الله صلى الله عليه وسلم يُقبلك لما قبلتك .إذاُ الأصل في هذا التقبيل أن نجري فيه على سنة ماضية , لا أن نحكم على الأمور – كما أشرنا آنفا – فنقول : هذا حسن , وماذا في ذلك ؟! اذكروا معي موقف زيد بن ثابت كيف تجاه عرض أبي بكر وعمر عليه] في[(5) جمع القران لحفظ القران من الضياع , لقـد قال : كيف تفعـلون شيئاً ما فعله رسول الله صلى الله عـليه وسلم ؟! فليس عند المسلمين اليوم هذا الفقه في الدين إطلاقاً . إذا قيل للمقبل للمصحف : كيف تفعل شيئاً لم يفعله رسول الله صلى الله عليه وسلم ؟! واجهك بأجوبة غريبة عجيبة جداً , منها : يا أخي ! وماذا في ذلك ؟! هذا فيه تعظــيم للـقران ! فــقل له : يا أخي ! هذا الكلامُ يعاد عليك : وهل الرسول صلى الله عليه وسلم كان لا يُعظم القران ؟ لا شك أنه كان يعظم القران , ومع ذلك لم يُقبله , أو يقولون : أنت تنكر علينا تقبيل المصحف ! و ها أنت تركب السيارة , وتسافر بالطيارة وهذه أشياء من البدعة ؟! يأتي الرد على ما سمعتم أن البدعة التي هي ضلالة , إنما ما كان منها في الدين . أما في الدنيا , فكما ألمحنا آنفا أنه قد تكون جائزة , وقد تكون محرمة إلى آخره , وهذا الشيء معروف , ولا يحتاج إلى مثال . فالرجل يركب الطيارة ليسافر إلى بيت الله الحرام للحج , لا شك أنه جائز , والرجل الذي يركب الطيارة ليسافر إلى بلاد الغرب ويحُج إليه , لا شك أن هذه معصية , وهكذا .
تعليق
استدلال الشيخ الألبانى رحمه الله على بدعية تقبيل المصحف ليس استدلالا قويا بل لقد استدل بعموم الحديث (( كل محدثة بدعة ..)) وهو يرى أن التقبيل من العبادات بدليل تقبيل الحجر الأسود ؛وليس الأمر على هذا النحو .وهل معنى تبديع تقبيل المصحف أن فاعله يسأل أتفعله تعظيمًا أم لا فإن قال تعظيمًا كان مبتدعًا وإن قال عبثًا فلا شىء عليه ؟؟‍‍‍‍‍
الخلاصة والراجح عندي
أن تقبيل المصحف جائز بل مستحب وذلك لما فيه من تعظيم لكلام الله المكتوب بين الدفتين، قال تعالى (ذلك ومن يعظم شعائر الله فإنها من تقوى القلوب ) والأثار التي سلف ذكرها يستأنس بها في ذلك، لكنها ليست أصلاً في المسألة حتى ينتفي الحكم بضعفها أو عدم صحتها.
وعلى فرض ضعف حديث عكرمه فهناك خلاف قائم حول العمل بالحديث الضعيف !
كما أحب أن أنصح إخواني بعدم التشدد في مثل هذه الأمور، فليس فيه ما يخالف أصلاً ولا نصاً، والفعل بحد ذاته حسن يحمد فاعله، فأرجو أن لا نكون سبباً في محي تعظيم الشعائر من قلوب العامة بحجة أن الأثر ضعيف
لك ألا تقبل المصحف ولكن لا تنه من قبله أو رفعه من على الأرض أو طيبه ووضعه فى أشرف مكان وأرجو من الإخوة الكرام عدم التسرع فى إطلاق تعميم حكم البدعة طالما في المسألة أقوال .

Religious Freedom In Canada Must Be Respected and Protected

Recently, a group calling itself the Muslim Canadian Congress (MCC) asked Prime Minister Stephen Harper’s government to ban the niqab because they say it oppresses women and that the practice compromises Canada's security. The group says that the wearing of niqab is an extremist practice and that it is a "political symbol of Saudi inspired Islamic extremism." The group holds the position that they are providing a voice for those women who are otherwise being silenced into submission.

In reaction to these statements from MCC, a coalition of mainstream Canadian Muslim organizations, in conjunction with Canadian Islamic scholars, issued a statement reaffirming freedom of religion and conscience in Canada. The statement said in part that "All Canadians, whether Muslim or not, are guaranteed by the Charter of Rights and Freedoms the freedom of religion and conscience," and that "the state has no business in the wardrobes of the nation."

The MCC, on the other hand, dismissed the argument that the wearing of niqab by Muslim women is protected by the Charter's guarantee of religious freedom and argue that "Invoking religious freedom to conceal one's identity and promote a political ideology, is disingenuous."

In essence, the MCC, who say they are speaking on behalf of Muslim women with a view to expanding their freedoms, actually desires to restrict Muslim women's freedom by taking away their constitutionally protected rights of freedom of religion and conscience. They desire to have a law put in place which would force Muslim women to remove what they feel to be a religiously mandated practice. We should be wary of any attempts by governments to restrict people's religious freedoms as doing so can lead to a lot of abuses.

Congratulations, you made it! You have successfully completed the fast of the month of Ramadan. Whether this is your first complete Ramadan fast or your 50th, you have done a wonderful thing because the Prophet Muhammad (peace be upon him) has stated that, "whoever fasts during Ramadan out of sincere faith and hoping to attain Allah's rewards, then all his past sins will be forgiven."

One thing you have learned during this month of fasting is that sometimes it can be quite hard. Some days you did not feel like fasting or praying as you were tired. But you overcame your desires and now today, on this first day of Eid, you are celebrating with millions and millions of other Muslims. This makes you feel happy and proud, doesn't it? You also feel a sense of accomplishment because, despite the difficulties you encountered along the way, you did not give up and have won the victory over your desires.

One of the main lessons which Ramadan teaches us is that if we want to accomplishment something important or worthwhile it takes effort. Sometimes things can become really difficult and challenging but when we keep focused on our goal then eventually we will achieve that which we set out to do. These lessons not only apply to Ramadan but to anything we are trying to achieve in life. For example, many of you have begun a new year of studies at school. Sometimes the homework can be really difficult and you feel like throwing up your hands in frustration. "This is just too hard, I cannot do it," you say. But you keep working and applying yourself because you are aware of the long-term benefits of studying and being a good student. You will want to graduate and find a good paying job so that you can lead a happy life and support a family of your own, or maybe you desire to become a scholar in your chosen field. Everyday, you open your books and attend classes because you know that eventually all of your efforts will pay off.

And so it is with Islam also. When we apply ourselves with patience and perseverance to please Allah we know there will be a pay off. Allah will be pleased with us and He will grant us paradise, which is the ultimate achievement.

Yes, sometimes it can be really hard, but the ultimate prize - paradise- makes the effort with it. Remember the prophet Mummahad (peace be up him) stated that “for the fasting person there are two times of joy; a time when he breaks his fast and a time of joy when he meets his Lord.” The Prophet also said, "The fast and the Qur'an are two intercessors for the servant of Allah on the Day of Resurrection. The fast will say: 'O Lord, I prevented him from his food and desires during the day. Let me intercede for him.' The Qur'an will say: 'I prevented him from sleeping at night. Let me intercede for him.' And their intercession will be accepted."

So today, as you celebrate the completion of your fast just remember that you are one step closer to your goal of paradise. Don't give up now that Ramadan is over. Keep making effort by remaining steadfast in your prayers and doing good deeds. Read the Quran everyday and be kind to your parents as well as those you deal with on a daily basis.

You will soon meet Allah and you will be happy that you fasted.

For Immediate Release to Members of the Muslim Community in Ottawa
In the name of Allah, the Compassionate, the Merciful
With the hope of uniting the Ottawa Muslim Community on the beginning and end of the month of
Ramadan, Muslim organizations in Ottawa held a meeting on Sunday September 13, 2009 in order to
discuss this issue. The result was an agreement between attendees that has shortly after gained
acceptance from most organizations in the city. These organizations now collectively form the “Ottawa Hilal Committee”.
It gives pleasure to the undersigned Ottawa Muslims organizations to announce to our community
that we have reached an agreement to adopt the following criteria to determine the beginning and end of
the lunar months of the year.
1- Moon sighting in North America is adopted as the methodology to be used.
2- Astronomical calculations will be used to rule out sighting possibility.
3- Sightings using visual aid will be accepted.
4- The committee will exert all efforts to perform local sighting within the city of Ottawa with the
aid of a local astronomer.
5- All committee members are expected to use their contacts in North America to convey verified
and credible sighting reports to the “Ottawa Hilal Committee”.
6- The committee will also use sighting information from other committees in North America,
such as (i.e. not limited to) the Hilal Committee of Toronto (www.hilalcommittee.com),
Moonsighting Committee Worldwide (www.moonsighting.com).
7- Members are expected to share a list of their sources/contacts with the rest of the Committee
members.
8- The Committee should work on implementing these criteria for all months of the year.
9- A meeting is to be held on the 29th of the month to take decision based on the above criteria, or
otherwise decide the completion of the month 30 days.
10- A joint statement is to be issued by member organizations declaring the Committee’s decision
around three hours after maghrib prayer on the 29th of the month.
11- Every member organization needs to appoint an official representative to the “Ottawa Hilal
Committee”

Zakat Al Fitr
Zakat al Fitr is an obligatory charity on every Muslim at the end of the month of Ramadan. Ibn `Umar said: "The Prophet, sallaallahu `alayhe wa sallam, enjoined the payment of one Sa'a of dates or one Sa'a of barley as Zakat al-Fitr on every Muslim, young and old, male and female, free and slave." (Related by al-Bukhari and Muslim)
The purpose of Zakat al-Fitr is to purify the one who has fasted from any type of indecent act or speech he might have committed while fasting. It also helps the poor and the needy. Ibn Abbas said: "The Messenger of Allah, sallaallahu `alayhe wa sallam, enjoined Zakat al-Fitr on the one who fasts to shield him from any indecent act or speech and for the purpose of providing food for the needy." (Related by Abu Dawud and Ibn Majah.)
The Amount of Zakat al-Fitr
As the first hadeeth indicated, the amount of Zakat al-Fitr is one Sa'a. Sa'a is a volume measure corresponding approximately to the volume of 5 lb of good wheat. The material of the Zakat can be either dates, barley, wheat, rice, corn or similar items considered as basic foods. Abu Saeed said: "We used to give for Zakat al-Fitr on behalf of every child, aged person, free man or slave during the lifetime of the Messenger of Allah, sallaallahu `alayhe wa sallam, one Sa'a of food, or one Sa'a of dried yogurt, or one Sa'a of barley, or one Sa'a of dates, or one Sa'a of raisins." (Related by al-Bukhari and Muslim.)
The Time for Zakat al-Fitr
Zakat al-Fitr has to be paid by the end of Ramadhan. There are two times to pay Zakat al-Fitr. Either one or two days before Eid as 'Umar used to do, or the day of Eid before the Eid prayer. Ibn `Umar reported that the Prophet, sallaallahu `alayhe wa sallam, ordered them to pay Zakat al-Fitr before they go out to perform the Eid prayer. If Zakat al-Fitr is paid after the Eid prayer, it will only be considered as regular charity. The Prophet, sallaallahu `alayhe wa sallam, said: "If one pays Zakat al-Fitr before the Salat, it is considered an accepted Zakat, if he pays it after the Salat, it is considered an ordinary charity." (Related by Abu Dawud.)
Zakat al-Fitr is to be given to the same eight categories or people as in the other types of Zakat. Some scholars say that the poor and the needy are the most deserving ones since the Prophet, sallaallahu `alayhe wa sallam, said that it had "...the purpose of providing food for the needy"

IS IT PRMISSIBLLE TO PAY ZAKAT AL-FITR IN MONEY?

The Hanafis permitted the payment of Zakat al-Fitr in money. This is the view of Al-Thawri, Al-Hasan al-Basri, and `Umar ibn `Abd al-`Aziz. However, the other three schools did not permit this. Their argument is that the Prophet did not do so and hence its payment in money contradicts the Sunnah of the Prophet.

All blessing and appreciation to Allah and peace be brought upon his prophets,
Dear beloved Muslims, Al Salamu Alaykum wa Rahmtu Allah Wa Barakatuh,
As we come closer to the month of Ramadan, we come to face the issue of determining the beginning of Islamic months. Islamic scholars differ regarding this issue; there are three main streams, as following:
- The first stream: The acceptance of international moon- sighting.
- The second main stream: The acceptance of local moon- sighting, which is the disagreement in sight seeing.
- The third stream: To depend on astronomical calculation.
Before we go further into moon- sighting, collecting evidence, advice of scholars and astronomers, we have to list some scientific and Islamic Rules (Shari’a) facts.
Some Facts:
 It has been decided according to the Shari’a and logic that there are different locations of sighting the moon.
 To unify Muslims is not by unifying the start of the month and Eid (Feast) as some people claim. Unifying Muslims is agreeing with the Qura’an and Sunnah, accepting each other and not giving opinions unless supported by evidence from the Shari’a. (Review: fatwa of Muslim World League and Ibn Othaymeen).
 It is better to follow an opinion upon which the community or Ummah agrees than one's own preferred opinion, if following the latter would cause divisions.
 In regards of International sight seeing, it is not accurate that Saudi Arabia is the most ideal location for moon-sighting. According to astronomers, Morocco would be the most ideal Arabic country for crescent moon-sighting; it has 270 points of sight and approximately three thousand people sight the crescent every month. Morocco also has the lowest percentage of error when sighting the crescent. (Article of astronomer Mohammed Shwakat Odah – www.islamway.com)

 The evidences of moon-sighting using vision in Shari’a are not decisive (qata’i), however it allowes for different interpretations; for example, the Prophet (pbuh) said “If you see it, fast, and if you see it (again), stop fasting. If you do not see it, determine it by calculation.” (Reported by Al Bukhari, vol. 5, p. 2467, Muslim vol 2 # 2550. This hadith “faqdirou lahu”فا قدوروا له " “ opened the doors for scholars to conclude that the calculation method of determining a new month is in accordance with the Shari’a. (Review fatwa of North America Islamic Association)
 In regards of where a Muslim would stand when the scholars disagree, it is agreed that there are two types of people on the matter: The first type is that of the knowledgeable or those who are seeking knowledge; The second type consists of common people.
The first type of people is capable of collecting scholarly pieces of evidence, reviewing, discussing, reconciling, and selecting the most preferred opionions among them. This type of people is obligated to follow the evidence as they see fit. The only exception in this case is when what they prefer to follow as individuals may lead to serious divisions among Muslims. That is why the Prophet (Peace be Upon Him) says, "Fasting begins when the people begin to fast; and the last day of fasting is when the people end their fast." The same applies (out of courtesy and good manners) when the scholars disagree. This means following the majority, except where that entails introduction of bid'ah or innovation in religion, or clear disobedience of and deviation from the Kur'an and Sunnah
The second type of people refers to those who do not have the capacity to follow scholarly evidence in shariah or to discuss it, weigh between the stronger and the strongest, and what is preferable and what is preferred. This still applies even when such people attain the highest positions and degrees in life.
Allah’s verse applies to this category of people – It says, “Ask the people of knowledge if you do not
know)they should search for the most knowledgeable or what the majority agree upon and follow accordingly. Even where the Imam to such people makes an honest mistake in his search for a proper answer or solution, they are still considered right under the circumstance, and will be rewarded, as they must have done what it takes and within their capacity to find a solution; for Allah does not burden a soul beyond its capacity. Their initiative -alone proves that they had aspired to do what Allah loves.
As for the Imam in such a situation, he too will be rewarded, because the Prophet (PBUH) says, “When the leader/ruler strives to find a solution and makes a mistake, he gets one reward...”
 It is a well-established fact in Shari’ah that diversity of opinion can only be based on evidence, such as what the Prophet (PBUH) confirmed, for example, the Bani Quraidha incident and others. In this case, scholars cannot discredit one another or marginalize the knowledge and roles of others, so long as they follow the Qur’an and Sunnah and what their established evidence says, if they are scholars or seekers of knowledge, or followers of any of the Imams that implement the teachings of the Qur’an and Sunnah.

Accordingly, after a thorough study of the state and the reality of Muslims in the West and the rules of Shari'a and guidance from astronomers, the following has been decided:

• Relying on sighting of the moon using visual devices such as a Telescope and other reliable tools.
• Relying on the declaration of Muslims in North America with regard to their moon sighting (this is based on the differences of sightings).
• To take the opinion of astronomers at least when ruling out the possibility of sighting the crescent.
• To set up a committee to represent organizations and Masjids in Ottawa; and using the assistance of one of astronomers (a non-Muslim if a Muslim Astronomer is unavailable); the Committee to be called Ottawa Moon Sighting Committee; and will be entrusted with sighting the Crescent. Members will be trained on how to sight the Crescent using the Telescope and other methods.

El hamdulilah we have already formed this Committee

• In case of not forming the Committee, or in case its incompetence, or in case of having bad weather conditions, consultation with other committees outside of Ottawa may be pursued as long as these places are located within the same longitude in Canada and the United States (maximum three hour time difference).
• The purpose of this procedure is to facilitate the process and to prepare the Muslim community for Ramadan. As it has been decided according the principles of jurisprudence “hardship brings facilitation."For Example: if we were told after four or five hours that Ramadan is on the next day, who can inform all the Muslim community about this? And Muslims are required to prepare for Ramadan. If they don’t know ahead of time, they will be confused and uncertain.

• If the crescent could not be sighted due to bad weather conditions in Ottawa, and information did not reach us from outside Ottawa, the Ottawa’s Muslim community will have to complete the month of Shaban for 30 days.
• To respect opinions contrary to our decisions, and to encourage discussions on the subject of sighting the Crescent; and to pray to Allah for acceptance and reward for every good intention.

10 Reasons Why Islam is the Religion of Truth

1. In 23 Years, Muslims Went from Being Powerless to Control the World.When Islam started in Mecca, it was the prophet Mohammed by himself. A one man religion. He was exposed to punishments and oppression. The people who first entered Islam were weak and also were oppressed and tortured by the pagans of Mecca (their relatives). Forward 23 years later to see the transformation of these uneducated powerless individuals to the most powerful ones and to control the world.
The Arabs at the time of the prophet peace be upon him (6th century) were tribes and clans fighting each other. The Romans and the Persians were vast powerful empires. Forward 23 years later to see how some powerless individuals were able climb the mountain of world power to take over the Persian empire and the Roman empire and introduce new world order.

Not only did this transformation achieve miraculousness in its happenings but it’s also marvelous in its timing and its duration.

Had it not been to Islam, the world would be different (much worse). The heroes of Islam would not have been heroes but would have been forgotten.

2. The Quran and its Eloquence as a Linguistic Miracle.

As the Arabs of that time were so linguistically gifted, a linguistic miracle was fit for the situation. Quran was sent to people who were so eloquent in the Arabic language. If the Quran was not a linguistic miracle, then any of the Arabs and Arab poets in Mekkah (where the prophet peace be upon him stayed for 13 years calling people to worship Allah alone) would come up and say some poetry to challenge the Quran (since the challenge to them was clear) but none was able to challenge the eloquence of the Quran.

The miraculousness of the Quran is an axiom to whomever studies Arabic academically.

3. Inheritance and Economic System in Islam

Not only that, but the Islamic heritage system was revealed in only 2 verses. The Islamic heritage system is one that is comprehensive and astonishing in its detail. It has covered all cases and all situations in the most fair way. Such system was not known at all at the time of the prophet peace be upon him. No other religion has such system. How can an illiterate man come up with such system? A system that had no equal at that time.

The Islamic economic system is also a system of wonders. It has the compatibility to encompass all types of old and new business maneuvers. It also has the ability to provide welfare for all people. It’s not a theory but a system which is implemented throughout the world and has been applied through history with ultimate success.

How can an illiterate man from the 6th century come up with such system? How can a Sheppard in the desert in the Arabic peninsula design such a system? A system that had no equal at its time. A system which competes with the most recent business and economics sciences and is proven to have more success.

The answer is: he couldn’t. It was revealed to him.

4. Islam is the Only Religion that Makes Sense in Terms of Spirituality and Materialism

In our world, religion becomes more of a shopping center where almost every person could come up with a religion or a version of a religion. It makes it hard to distinguish the true religion from the fake ones. Some have went all spiritual on the scale of spirituality. Others have gone all the way to materialism. Only Islam can gather both ends in a harmonic mixture. In Islam, Muslims are to build this earth and make it prosper be it in agriculture, industry, sciences, etc. We are ordered to protect life and property of all people who do not transgress and oppress us. We are ordered that if the day of Judgement comes and one has a plant in his hand to plant it. We are allowed to marry, have children and enjoy life.

On the other hand, we are also responsible for our actions and we will be accounted for them. We should always work for the hereafter and wish to please God our creator.

Islam is also a whole way of life. It deals with economics. It sets rules for dealings between humans and animals to dealings between humans and humans to rights of neighbors and parents to the relationship between human beings and the creator.

5. Scientific Proof in the Quran and the Sunnah

Just to make it clear, the Quran is not a science book but it does not contradict with science.

6. Quran is the Only Book which Has Been Protected from Altercations

Whether you are a Muslim or not, one thing all scholars have agreed upon: The Quran has been preserved as it was revealed to the prophet in the 6th century. Copies of the Quran are still available in Tashqand and Cairo. One of the properties of the Muslim Nation is “ISNAD”. Isnad means means having narration chains where each person in the narration chain is well known and has his life recorded and studies.

The holy Quran has been narrated through narration chains where a large group of narrators who are of very strong memory and minds have narrated the same text from one generation to the next (with the condition of actually meeting each other and listening to each other with no time gaps). This large group of narrators cannot all agree on a lie. The names and the life stories of EACH person is recorded and studied. Each narrator has his whole family recorded.

These narrations have agreed with the copies from the Quran.

Compare that with the current bible for example where there is no recorded narration chains (without putting the condition of having no time gaps or even having names for those narrators). Compare the Quran with current bible where you have thousands of manuscripts; no two are the same. Compare that with the writers of the bible where you only have one name: John who? Luke who? What is their last name?

The Quran has been revealed in Arabic and it’s read in Arabic. For the first time, the people speak the language of the prophet not the other way around. There are translations of the Quran in different languages but the Quran is in Arabic and should be read in Arabic noting that ‘translations of meaning’ is different than a version.

The Sunnah or the traditions of the prophet are protected through the same narration chains.

That being said; the Quran and the Sunnah have two distinct styles which have never contradicted.

7. God in Islam is the Creator

Most people who do not believe in God have an altered image of God. I do not believe in God who has human qualities. I do not believe in God who is born and can die. God describes himself in the Quran as: Allâh! Lâ ilâha illa Huwa (none has the right to be worshipped but He), Al-Hayyul-Qayyum (the Ever Living, the One Who sustains and protects all that exists). Neither slumber nor sleep overtakes Him. To Him belongs whatever is in the heavens and whatever is on the earth. Who is he that can intercede with Him except with His Permission? He knows what happens to them (His creatures) in this world, and what will happen to them in the Hereafter. And they will never compass anything of His Knowledge except that which He wills. His Kursî [1] extends over the heavens and the earth, and He feels no fatigue in guarding and preserving them. And He is the Most High, the Most Great. [This Verse 2:255 is called Ayat-ul-Kursî ]

Rulings on Fasting For Women

1. A woman who has reached the age of puberty, but is too shy to tell anyone, so she does not fast, has to repent and make up the days she has missed, as well as feeding a poor person for each day, as an act of expiation for delaying her fast, if the following Ramadaan comes and she has not yet made up those days. Her case is like that of a woman who fasts the days of her period out of shyness, and does not make them up later.

2. If a woman does not know exactly how many days she has missed, she should fast until she is fairly certain that she has made up the days she had missed and not made up from previous Ramadaans, and offer the expiation for delaying for each day. She can do this at the same time as fasting or separately, depending on what she is able to do

3. A woman should not fast – except during Ramadaan – if her husband is present without his permission, but if he is travelling then it does not matter.

4. When a menstruating woman sees the white substance – which is discharged by the uterus when the period is finished – by which a woman knows that she has now become taahir (pure), she should have the intention to fast from the night before and should fast. If she does not have a time when she knows she is taahir, she should insert a piece of cotton or something similar, and if it comes out clean, she should fast, and if she starts to bleed again, she should stop fasting, whether the blood is a flow or just spotting, because it breaks the fast as long as it comes at the time of the period. (Fataawa al-Lajnah al-Daa’imah, 10/154).

5. If the cessation of bleeding continues until Maghrib, and she has fasted with the intention from the night before, then her fast is valid. If a woman feels the movement of menstrual blood inside her, but is does not come out until after the sun has set, her fast is valid and she does not have to make the day up later.

6. If a woman’s period or post-natal bleeding ceases during the night, and she makes the intention to fast, but dawn comes before she is able to do ghusl, according to all the scholars her fast is valid. (al-Fath, 4/148)

7. If a woman knows that her period will come tomorrow, she should still continue her intention and keep fasting; she should not break her fast until she actually sees the blood.

8. It is better for a menstruating woman to remain natural and accept what Allaah has decreed for her by not taking any medication to prevent her from bleeding. She should be content with what Allaah accepts from her of breaking her fast during her period and making those days up later. This is how the Mothers of the Believers and the women of the salaf were. (Fataawa al-Lajnah al-Daa’imah, 10/151). Moreover, there is medical evidence to prove that many of the things used to prevent bleeding are in fact harmful, and many women have suffered from irregular periods as a result of taking them. However, if a woman does that and takes something to stop the bleeding, then fasts, this is OK.

9. Istihaadah (non-menstrual vaginal bleeding) does not have any effect on the validity of the fast.

10. If a pregnant woman miscarries and the foetus is formed or has a discernible outline of any part of the body, such as a head or hand, then her blood is nifaas; if, however, she passes something that looks like a blood clot (‘alaq) or a chewed piece of meat that has no discernible human features, her bleeding is istihaadah and she has to fast, if she is able, otherwise she can break her fast and make it up later on. (Fataawa al-Lajnah al-Daa’imah, 10/224). Once she becomes clean after having an operation to clean the womb (D&C), she should fast. The scholars stated that the embryo is considered to start taking shape after 80 days of pregnancy.

11. If a woman becomes clean from nifaas before forty days, she should fast and do ghusl so that she can pray. (al-Mughni ma’a al-Sharh al-Kabeer, 1/360). If the bleeding resumes within forty days after the birth, she should stop fasting, because this is still nifaas. If the bleeding continues after the fortieth day, she should make the intention to fast and do ghusl (according to the majority of scholars), and any bleeding beyond the fortieth day is considered to be istihaadah (non-menstrual bleeding) – unless it coincides with the usual time of her period, in which case it is hayd (menstrual blood).

12. If a breastfeeding woman fasts during the day and sees a spot of blood during the night, although she was clean during the day, her fast is still valid. (Fataawa al-Lajnah al-Daa’imah, 10/150)

13. According to the most correct opinion, a woman who is pregnant or breastfeeding is regarded as being like one who is ill, so she is permitted not to fast, and she only has to make up the days that she missed, whether she fears for herself or for her child. The Prophet (peace and blessings of Allaah be upon him) said: “Allaah has lifted the obligation of fasting and part of the prayer from the traveller, and He has lifted the obligation of fasting from the pregnant and breastfeeding woman.” (Reported by al-Tirmidhi, 3/85; he said (it is a) hasan hadeeth). If a pregnant woman fasts and experiences some bleeding, her fast is still valid; this does not affect her fast at all. (Fataawa al-Lajnah al-Daa’imah, 10/225).

14. In the case of a woman who is obliged to fast, if her husband has intercourse with her during the day in Ramadaan with her consent, then the ruling that applies to him also applies to her. If, however, he forces her to do that, she should do her best to resist him, and she does not have to offer expiation. Ibn ‘Aqeel (may Allaah have mercy on him) said: “In the case of a man who has intercourse with his wife during the day in Ramadaan whilst she is sleeping, she does not have to offer expiation.” But to be on the safe side, she should make up that fast later on. (Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) was of the opinion that this did not invalidate her fast at all).

15. A woman who knows that her husband cannot control himself should keep away from him and not adorn herself during the day in Ramadaan.

16. Women have to make up the fasts that they miss during Ramadaan, even without their husbands’ knowledge. It is not a condition for an obligatory fast for a woman to have the permission of her husband. If a woman starts to observe an obligatory fast, she is not allowed to break it except for a legitimate reason. Her husband is not permitted to order her to break her fast when she is making up a day that she has missed; he is not allowed to have intercourse with her when she is making up a missed fast, and she is not allowed to obey him in that regard. (Fataawa al-Lajnah al-Daa’imah, 10/353).

17. In the case of voluntary fasts, a woman is not permitted to start a non-obligatory fast when her husband is present without his permission, because of the hadeeth narrated by Abu Hurayrah (may Allaah be pleased with him), according to which the Prophet (peace and blessings of Allaah be upon him) said: “No woman should fast when her husband is present except with his permission.” (Reported by al-Bukhaari, 4793).

From the events of the emigration to Madinah, it is clear that the Prophet, sallallahu `alaihi wa sallam, never stayed in any place unless he built a mosque therein for the believers to gather. He built the Qubaa mosque when he stayed there for four days. He also built a mosque between Qubaa and Madinah when the time of the Friday prayer came while he was in the residence of the tribe of Salimibn Auf in the heart of Ranonaa’ Valley.

When he arrived in Madinah, the first act he performed was the building of a mosque.

This indicates the importance of a mosque in Islam. All acts of worship (ibadah) in Islam are for the purification of the soul, refinement of morals, and strengthening the ties of mutual cooperation among the Muslims. The congregational prayers and the Friday and Eid prayers are strong examples of the nature of the Muslim community and in the unity of their opinions, goals and cooperation in achieving righteousness and in fearing Allah.

Thus, if this is the case with the acts of worship, it is no wonder that mosques carry a great social and spiritual place in the lives of the Muslims. The mosque is the thing which unites them and their efforts. It refines their souls and awakens their minds and hearts. It solves their problems. The mosque shows their strength and cohesiveness.

The history of the mosques in Islam has proved that from them come the great armies of Islam which rush to fill the earth with Allah’s guidance. From the mosques the beams of the light of guidance emanate for the Muslims and others. Inside them, the seeds of Islamic civilization develop and grow.

Is it not true that Abu Bakr, `Umar, `Uthman, Ali, Khalid, Saad, Abu Ubaidah, and their likes from among the greats of Islamic history were but the students of the Muhammad’s school which was headquartered in the Prophet’s mosques?

Another special characteristic of the mosques in Islam is that the word of truth emanates from them every week on the tongues of the preachers. The topic may be about forbidding evil and enjoining good or an invitation to do some good, an awakening for the heedless, an invitation to assembly, objections to a wrongdoer, or a warning about a tyrant. We (i.e. the author and his generation) witnessed, when we were still children, how the mosques were the centers of the nationalist movement against the French occupation. From the mosques also clame the leaders of the Jihad against colonialism in general and against Zionism (Israel) in specific.

If we see the mosques crippled and not playing their great role today, it is due to the fault of some of their paid preachers, mercenaries or the ignorant. On the day when the strong leaders and the scholars of Islamic legislation, sincere to Allah and His Messenger, give advice to the leaders and common Muslims and ascend the pulpits and lead the prayers, on that day the mosque will return to its leading position in the Islamic society. The mosque will return to its role in raising real men, graduating heroes, reforming corruption, fighting evil and building society upon the foundation of fearing and pleasing Allah alone. We hope for this to take place, Allah willing, when the vanguard of our purified, believing youths, who are educated with Allah’s religion and who behave with the Prophet’s manners, occupy the pulpits and the rooms of the mosques.

Does a woman have to have her fathers permission to marry?

If the father has a legitimate reason for objecting, then he must be obeyed and not disobeyed; disobeying him and going against his wishes comes under the heading of disobedience towards parents (‘uqooq) which is a major sin. But if the reason for his objection is a worldly or social matter that is contrary to Islam and the aims of sharee’ah, then there is no sin in going against his wishes, but you should try hard to please him and convince him.see Al-Muntaqa min Fataawa al-Shaykh al-Fawzaan (5/242).

But we should notice that it is essential for a woman to have a wali (guardian) to do the marriage contract for her. This is one of the pillars or essential parts of a shar’i marriage. It is not permissible for a woman to give herself in marriage without a shar’i guardian. If she does that, the marriage is invalid and is not a permissible, shar’i marriage, because the Prophet (peace and blessings of Allaah be upon him) said: “Any woman who gets married without the permission of her guardian, her marriage is invalid, her marriage is invalid, her marriage is invalid.” Narrated by al-Tirmidhi (1002) and classed as saheeh by al-Albaani in Saheeh al-Tirmidhi

Does a woman have a right to ask her husband to move to a place she thinks will be better for her and her family and for the sake of Islam?

If your husband did not provide you with a separate accommodation, you have the right to ask him to offer you this accommodation. However, in principle, a woman is not permitted to go out of her husband's house without his permission unless she has a sound reason for doing so. Therefore, it is permissible for you to ask him to move out to another house where you will be more secure about your religion and dignity especially if you are actually harmed (with regards to your faith) by staying in that house as you mentioned in the question.
I advise you to contiue in advising your husband with wisdom and soft words and guiding him to do good.

If someone has tattoos from before they converted should they remove them even after they have been forgiven?

The Muslim must realize that Islam erases any sins that came before it, and indeed Allaah changes them into good deeds, as He says (interpretation of the meaning): “Except those who repent and believe (in Islamic Monotheism), and do righteous deeds; for those, Allaah will change their sins into good deeds, and Allaah is Oft-Forgiving, Most Merciful”[al-Furqaan 25:70] It was narrated that ‘Amr ibn al-‘Aas said: When Allaah put Islam in my heart, I went to the Prophet [an error occurred while processing this directive] (peace and blessings of Allaah be upon him) and said: “Give me your right hand so that I may give you my oath of allegiance.” So he held out his hand, but I held my hand back. He said, “What is the matter, O ‘Amr?” I said, “I want to make a condition.” He said, “What is your condition?” I said, “That I be forgiven.” He said, “Do you not know that Islam wipes out whatever came before it, and that hijrah (migration for the sake of Allaah) wipes out whatever came before it, and that Hajj wipes out whatever came before it?” (Narrated by Muslim, 121). This hadeeth indicates that whoever becomes Muslim is forgiven for all the bad deeds that he may have done before he became a Muslim. Secondly: It was narrated from the Prophet [an error occurred while processing this directive] (peace and blessings of Allaah be upon him) that tattooing is haraam (forbidden). It was narrated that Abu Juhayfah (may Allaah be pleased with him) said: “The Prophet [an error occurred while processing this directive] (peace and blessings of Allaah be upon him) cursed the one who does tattoos, the one who has a tattoo done, the one who consumes riba (usury or interest) and the one who pays it, and he forbade the price of a dog and the earnings of a prostitute, and he cursed the image-makers.” (Narrated by al-Bukhaari, 5032). Tattooing is a major sin, but if a person repents from it, Allaah will accept his repentance. Thirdly: Modern medicine is able to remove tattoos; the remedy exists so you can easily get rid of it, in sha Allah.

Is it okay to pluck between the eye brows or not at all?

Firstly:It says in Fataawa al-Lajnah al-Daa’imah (17/133): “It is not permissibleto remove the hair of the eyebrows because this is the namas (plucking) for which the Messenger of Allaah (peace and blessings of Allaah be upon him) cursed those who do it, and it is a kind of changing the creation of Allaah, which is the action of the Shaytaan. If a woman’s husband tells her to do it, she should not obey him, because it is a sin, and there is no obedience to any created being if it involves disobedience towards the Creator. Rather obedience should only be with regard to things that are good and proper, as the Prophet (peace and blessings of Allaah be uponhim) said.”
Secondly: It is permissible to remove any hair from the face apart from the hair of the eyebrows.
It says in Fataawa al-Lajnah al-Daa’imah (17/130): “The evidence that itis permissible for a woman to remove hair from her body is the basic principle which states that it required for her to adorn herself for her husband. There is no evidence to suggest that this is not allowed, apart from the prohibition on al-namas (plucking), which means removing hairfrom the eyebrows.”
And it also says (5/197): “What is the Islamic ruling on removing hair that grows between the eyebrows?

The Committee replied: It is permissible to pluck it, because it is not part of the eyebrows.”

The Mercy of the Prophet (PBUH) with Mankind

Many Muslims might expect me to comment on what was written about me in Ottawa Citizen.
In fact, I will not comment about it for five reason :

To begin, I don't have time to waste in answering back and forth. My work speaks for me.

Next, When I was somehow troubled by what was written in Ottawa Citizen, I remembered Prophet Muhammad Pbuh when he has been harmed in European Media for five years.

We are still living in the realm of the Prophet, inspired by his life and guided by his spiritual model to show the world who the Messenger of Allah is. Let's see what the Prophet offered to humanity.

To those who haven't seen the Prophet and their hearts still yearn to see him;

To those who accuse the Prophet of cruelty; to those who ridicule the Prophet;

I present to them this gift of the divine guidance.

Enemies today gathered like crazed wolves against our Dear Prophet صلى الله عليه وسلم to depreciate him and discredit him, but Allah guaranteed his defence and his protection.

God Almighty says:

“And We have not sent you but as a mercy to the worlds.” (Al-Anbiyaa’ 21:107).

Prophet Muhammad (peace and blessings be upon him and his house) is the Prophet of mercy, sent by God as a mercy to all mankind; believers and non-believers. His mercy sheltered all humanity: men, women and children. Muhammad صلى الله عليه وسلم was merciful to all creatures including animals and birds.

An example of his mercy with the belivers

It was narrated that a man asked Prophet Muhammad for charity. Prophet Muhammad gave it and then asked the man, “Have I dealt with you rightfully?” The man answered, “no, and you have not dealt with me in a beautiful manner either.” The Muslims then got angry and rose up. Then he (the Prophet) waved them to stop. Prophet Muhammad (peace and blessings be upon him and his house) went home and sent him something. He then asked him once more, “Are you content?” the man answered, “Yes, I am. May Allah reward you with kindness in your family and kin.” The Prophet then said, “You said what you said and it left something in my companions’ hearts. So, what if you repeat what you have just said now before them, to take away what is in their hearts towards you?” The man agreed. In the evening or the day after, Prophet Muhammad told his companions, “This man showed his dissatisfaction so I increased what I gave him to let him be satisfied.” He turned then to the man and asked him “isn’t that right?” The man answered: “Yes, may God reward you with kindness in family and kin.”
The Prophet (peace and blessings be upon him and his house) then commented, “The example of me and this (man) is like that of a man whose camel went astray. People following the camel only increased its unwillingness. The man called to them, ‘leave me and my camel alone. I am more gentle and knowledgeable about it.’ He then turned to the camel, offering it some vegetation from the earth. He then called it back until it came forth, kneeled down,and he put the saddle on it and rode it away. Had I left you with what the man said you would have killed him and he would go to Hellfire” (Ahmed).

It was also narrated that Prophet Muhammad صلى الله عليه وسلم said, “I do not want any one of you to tell me off (backbite )about any of my Companions. I want to go out to (meet) you with a pure heart.” (Abu Dawud).

His Mercy with the non Muslim

When his people OF ATTA’AF did not believe him AND HURTED HIS BODY, Jibreel (the Archangel) came to him and said, “God Almighty heard the sayings and accusations of your people and He, Almighty, asked the angel of the mountains to obey any order from you against them. The angel of the mountains called Prophet Muhammad and said, “Ask for whatever you want, and I would crush them with the akhshabin (surrounding mountains).” Yet, Prophet Muhammad (peace and blessings be upon him and his house) said, “No, but I hope that Allah will bring out of their offspring people who worship Allah alone with no associates.”
A’ishah (may Allah be pleased with her) said, “Never was the Prophetmay peace be upon him left to make a choice between two matters but he would prefer the easier among them.”

Among the examples of his general mercy is his mercy with the hypocrites by saving them from death and captivity for their outward following of Islam in this life.
From his comprehensive mercy is his mercy with the non-believers by lifting the punishment of annihilation in this world. As for past nations, when Allah, majestic in His praise, sent them a messenger and they disbelieve him, they would be and tortured and annihilated. God almighty tells us how nations of Noah, `Aad, Thamoud, and Lout and others were tortured and how were they rewarded for their mockery.

His Mercy With Animals

He (peace and blessings be upon him and his house) used to commend having mercy on animals. He used to forbid his companions from hurting them, tiring them, overburdening them with heavy loads for long periods, torturing them, or pushing them beyond their limits, for that is a form of suffering.

He once entered the garden of man from the Ansar (Muslims of Madinah) and there was a camel. When the Prophet , saw the camel its eyes started teared. Then the Prophet of Allah (pbuh) came to it and rubbed its ears so it calmed down. Then the Prophet's eyes teared , he then said, “Who is the owner of this camel? Whose camel is this?” A young man from the Ansar told his ”O Messenger of Allah, it belongs to me.” Then he told him (peace and blessings be upon him and his house), “Do you not fear Allah with regard to this beast which Allah has let you own? It complained to me that you starve it and tire it by overworking it and using it beyond its capacity.

Prophet Muhammad warned against any human being causing a bird to feel panic about its little offspring. Someone took two chicks of a bird (hamra), which came in panic searching for its chicks. Prophet Muhammad (Peace and blessings be upon him and his house) then asked, “Who has distressed it by taking its chicks?” Then he asked them to return the chicks.

It was also reported that Prophet Muhammad prohibited the killing of a bird for the sake of pleasure and not for a specific beneficial need, the Prophet said, “Anyone who would kill a bird, this bird would come on Doomsday and say, “God, this person killed me for pleasure and not for benefit.

There are those who celebrate the birth of the Prophet, but in fact Muslims don't celebrate the birth of the Prophet. They live the ideals that he stood for .We live his memory in our lives, every day and every moment. We live his lead.
Celebrating the birth of the prophet in the sense of following his examples in his behaviour , in his compassion, in his kindness with his wives , in his generosity , in his trust in God
Some people in the west ask “What did he do for mankind? What’s the new thing that brought for humanity?
Let's focus today on social relations. In fact, the Prophet set up the foundation of the strong

society

How strongly did the prophet establish unity among community members?

To waht extent did he apply the Quranic principles of brotherhood?

In the Quran, Allah describes the meaning of unity in Islam embodied in the word "Mu'minoon" meaning believers. Believers in Islam are those who believe in Allah and his Messanger Muhammad and are united in brotherhood based (only) on Islam.
“The Mu’minoon are but a single Brotherhood.” (The Holy Qur’an, 49:10)
Allah further defines this Brotherhood by explaining that Muslims are awliyyaa’ (allies, friends, supporters) of one another, and this again is based solely on Islam:
“The Believers, men and women, are protectors one of another: they enjoin the ma`roof (all of Islam), and forbid the munkar (all that is evil): they observe regular prayers, pay Zakat, and obey Allah and His Messenger. On them will Allah pour His mercy: for Allah is Exalted in power, Wise.” (The Holy Qur’an, 9:71)
Muhammad (Salla Allahu `alaihi wa sallam) indicated in several Ahadith on unity and brotherhood as we can see in his Farewell Sermon (khuTbat ul-wadaa`):
“All mankind is from Adam and Eve, an Arab has no superiority over a non-Arab nor a non-Arab has any superiority over an Arab; also a white has no superiority over black nor a black has any superiority over white except by piety and good action. Learn that every Muslim is a brother to every Muslim and that the Muslims constitute one brotherhood.”
Other Ahadith further elaborate on the concept of unity and brotherhood:
"A Muslim is the brother of another Muslim. He does not oppress him, nor does he leave him at the mercy of others." (Sahih Muslim Book 032, Number 6219)
The Prophet said, "None of you will have faith till he wishes for his (Muslim) brother what he likes for himself." (Sahih Al-Bukhari Volume 1, Book 2, Number 12)
To begin, Islam urges its followers to meet each other five daily times as neighbours in congressional (jama’a) prayer. The prophet (recommended) the resident of each neighborhood to pray togheter in their respective neighborhood. On a larger scale, Islam obliges the residents of a whole village or city to pray together on Friday during the congregational prayer.
Third, We as Muslims are required to gather in masses for Eid prayer twice a year
Fourth, During hajj, Islam demonstrates the pinnacle of unity to strengthens the ties among the Muslim nation.

How does Islam support the unity of nation?
By what practical terms can we unite our community?

When We ponder over and think about the Islamic and prophetic Tradition we will find that Islam laid down the principle of unity through several practical rules.

To begin, the principle of respecting the law of the land.
The prophet respected the low of people of makkah by avoiding any raid on their lands.

فلم يقم بحرب عصابات او اراد ان يسحب بساط السيطرة والملك من تحت ارجلهم بل دعاهم الى الله ليطهرهم وليكون شرفا لهم في الدنيا واللآخرة وشارك النبي في حلف الفضول قبل البعثة وقال بعد البعثة
( لقد شهدت في دار عبد الله بن جدعان حلفًا ما أحب أن لى به حمر النعم، ولو أدعى به في الإسلام لأجبت
.

He didn't want to overrule them and strip them of their properties and powerful positions, but he called them to worship Allah, to purify them and to honor them by this worship in this life and in the hereafter.

He also participated in Al-foudool treaty before his prophet hood
He said after his prophet hood:” I witnessed in Dar Abdullah Ibn Gad'an Al-Foudool Accord. This accord was more endearing to me than having the best kinds of camels. If I were called again to witness it in the name of Islam, I would surely answer the call”
Do you see what the prophet mean ?!!! He sallah alyh wasllam highlight two issues:

1- If one day, you notice some shortcomings among some people, don't try to overrule them. Try instead to awaken them, to open their eyes to the truth. Insist on advising them. Extend your hand to rescue them.
2- If you are invited by anyone-- no matter who he is -- to participate in something good or to support a good cause, you should
grasp the opportunity and rush to participate. Don't say he is non- Muslim, or Shi'a or sufi. There is a big difference between cooperating with that person and giving up
your belief.

Second, the principle of respecting and supporting the ruler, president, Imam, and any leader ship as long as he followed Allah commands.

Third, Islam prohibited backbiting and gossiping
The wisdom behind prohibitions of backbiting and gossiping is to keep the community away from any division or deformation

the prophet said to two of the Sahaba

Being involved in backbiting your brother is more repulsive than eating this rotten meat.

It’s important to note that this description is meant for both the backbiter and the listener!!!

Fourth, the public good supersedes the individual interest the individual inter
I always recall the great story of khaled bin ea waleed in the battle of Yarmuk and how he reached to the news of his stepping down as leader of the army
Omer bin Elkhattb made a decision to set aside khaled as army leader for the benefit of Umma .
Omer noticed that some Muslims tended to be complicated as they relayed on the exceptional courage of khaled .

"إني لم اعزل خالداً عن سخطةٍ ولا خيانةٍ ولكنّ الناس فخّموه وفُتنوا به فخفت أن يوكلوا إليه، فحببت أن يعلموا أن الله هو الصانع وان لا يكونوا بعرض فتنة".

Omer wanted to reminded the Sahabah and us that Victory is not associated with one particular individual like khaled, but rather, Allah;s support comes through the unity and the piety of the ummah at large

I want to look with me at the behaviour of khaled and his reaction upon reciting the news of his demotion.
He asked the Omer’s messenger to wait until after the end of the battle.
Once the Muslims achieved the victory, khaled approached the new commander “ Abu Ubaida “who was named by the calif Khaled humbly and lovingly handed over the leadership to Abo Ubaida.He continued to serve the Muslim nation under ibn el jrrah
Based on his deep conviction and understanding of the true meaning of unity of Muslim nation, he was perfected happy to serve as a soldier in the army of ibn el jraah
Khaled had a much bigger and more noble objective than being merely te top
Khaled chose to seek Allah’s pleasure and serve Islam regardless of his position

أنا لا أقاتل من أجل عمر، وإنما أقاتل لإرضاء ربّ عمر".

These are some of the new things that the prophet brought to humanity!!

Unity is demonstrated in Islam at four different levels:

1- The level of the Ummah:

Wake up Muslims!! We are ONE Ummah, and we worship ONE GOD. It doesn't matter if your father is from China or if you mother is from Jamaica, we are one body, one entity, ONE Ummah! Allah the Almighty says: "Verily, this community of yours is a single community, and I am your Lord and Cherisher: therefore serve Me (and no other)" (21:92).

2- The level of the Country:

Love for one's country does not contradict with one's loyalty to the Ummah or to one's Faith in Allah. Prophet Muhammad (pbuh) demonstrated this form of bonding when he was migrating from Mecca to Medina. With Mecca now behind him, he looked back and said, "Oh Mecca, how much I love you, and if your people did not drive me out of you, I would have never lived in any other place."

3- The level of the Neighborhood:

Neighborhood ties are very important in Islam, to the extent that Prophet Muhammad (pbuh) said, "Jibreel kept on telling me to take care of my neighbors and strengthen my relationship with them until I thought that they would inherit me."

4- The level of the Family:

The importance of uterine relationships (Silat Al-Arham) and family ties are constantly referred to in the Quran, and they form a small-scale level of domestic unity.

We have seen that the rout of all evils is that some Muslim neglected the good manners. We have seen how far Islam goes in save guarding in preserving the Morals among Muslims.
Today, our topic will be How to bring up your children? How to raise your kids?
Many Canadian Muslims or emigrant keep asking me "We are good people Sheikh!!
We are adhering to Islam !!! but we are unhappy with our children , they used to pray but now they don't. They wear polite but now they aren't!! They don't respect us
I'm always recall that story of this guy who came, carrying his little baby, to one of our Imam
Our Sheikh How can I raise my child to be a good Muslim?
Imam said "how old is he" just one year "the father said .You Are Very Late .the scholar said: The Father Is Astonished .My sheikh .He is just one year .
Imam said:” Don't you know that there are a lot of things you should do before your child's birth”:
you should have done the following:
to choose a good wife to be a good mother
Seeking righteous children
When an individual wants to get married, they should have the intention to have righteous children and supplicate Allaah to this effect. The Prophet said: “Marry those women who are loving and fertile; for verily I want to be amongst those Prophets who have the most followers on the Day of Judgment.” [Ahmad and Al-Bayhaqi]

to pick up a good name
to feed him with money which you earns from halal
to strengthen your relation with your lord to be a good model
The parents should set the best example for their children. They should hasten to do that which is good and, likewise, hasten to abandon all that is evil. Children follow the example of their parents, and they love, respect and admire them.
to feed our belief mixed with his milk ( Putting emphasis on Religion:
Parents should consider Islam the most important affair in their life. They should raise their child to know that the most important aspect of life is being upright in religion, clinging to it firmly. Allaah Says (what means): “And this (Islam) was enjoined by Ibrahim upon his sons and by Ya’qoob, (saying), ‘O my sons! Allaah has chosen for you the (true) religion, then die not except in the faith of Islam.” [Quran; 2:132]

How did the prophet deal with the kids?
Look at him and listen to his wise words :one day the prophet sit-down wih alittel child
Narrated 'Umar bin Abi Salama: Who was the son of Um Salama, the wife of the Prophet, I was a boy under the care of Allah's Apostle and (I was eating from all sides of the dish.). So Allah's Apostle said to me, 'O boy! Mention the Name of Allah and eat with your right hand, and eat of the dish what is nearer to you." Since then I have applied those instructions when eating

What does "Mention the Name of Allah"mean?
the prophet ( may peace be upon him) pay his attention that every thing is from Allah he strengthen his relation with his lord…..!!!!
The prophet doesn't consider him as a kid, he considered him as an adult….!!!!
He respected his child 's mind
What does eat with your right hand"mean?
The prophet highlights the Muslim identity ,he plants on his mind that he is a Muslim, he guards him from the imitation and declination …
But if your child is left-hand, they can't eat with their right hand .It's permissible to eat with their left hand provided that they should do their best to train themselves in eating with right hand
What does eat of the dish what is nearer to you mean ?
the prophet teaches him the etiquettes of eating.

Brothers and sisters
Our children should be raised on the prophet’s words, for example:
It is narrated by Abu Huraira, “Our Lord, the Blessed, the Superior, comes every night down on the nearest Heaven to us when the last third of the night remains, saying, “Is there anyone to invoke Me, so that I may respond to invocation? Is there anyone to ask Me, so that I may grant him his request? Is there anyone seeking My forgiveness, so that I may forgive him

Abu Huraira that Allah's Messenger said, “If Allah loves a person, He calls Jibril (AS), saying, 'Allah loves so and so, O Jibril, love him.' So Jibril would love him and then would make an announcement in the Heavens: 'Allah has loved so-and-so therefore you should love him too.' So all the engels of the Heavens love him, and then he is granted the pleasure of the people on the earth.

On the authority of Abdullah ibn Abbass who said "One day I was riding behind the prophet at the same mount and said "O boy I shall teach you some words of advice
Be mindful of Allah, Allah will protect you. Be mindful of Allah, and you will find Him in the front of you,
If you ask, ask of Allah, if you seek help, seek help of Allah, know if the nation wear to gather together to benefit you of anything ,it would benefit you only with something that Allah has already prescribed for you And if the nation wear to gather together to harm you with anything , they would harm you only with something that Allah has already prescribed for you , the pens have been lifted and the pages have dried
All these ahadith and many others, help our children all see Allah’s Light in themselves and in all His creation, they get them so close to their creator and very tender with their parents.

الإنحراف الإعلامي وغيبوبة

الإعلام الهادف

لقد ساهم الإعلام بشكل كبير في انتشار ظاهرة الإنحلال الخلقي متمثلا في صور شتى منها انتشار الخيانة الزوجية ، وبيوت الدعارة ، ومنها الزواج العرفي أو إن شئت فسمّه( الزنا العرفي) .ونستطيع أن نلخص هذه المساهمة في النقاط التالية :
1- إثارة العاطفة بين الحالمين والمراهقين من خلال عرض الأفلام الرومانسية، والمسلسلات الداعية للإختلاط و الهروب من المنزل ، وتقديس المخادنة باسم الحب حتى لو في مقابل عقوق الوالدين ، وإعلان الرذيلة!!
2- إثارة الشهوة وتيسير أسبابها وقطع الحواجز بين تحصيلها ، من خلال عرض أن البطل دائما يشرب الخمر ، ويعاقر النساء ، وليس ملاما بل هو نجم وبطل (وحِرِك وشباب مروشن ..!!يعني طحن بلغة العصر)
3- التدرج في نشر الرذائل فعلي سبيل المثال : كان أول فكرة للزواج العرفي في أحد الأفلام لنجم من نجوم الكوميديا حيث دار حديثا بين البطل والنجمة مفاده طالما نحب بعض وربنا شايفنا مش مهم الناس ، ونتجوز زواج آدم _ هكذا زعموا _وهكذا أقنعوا الشباب بمشروعية الزنا،لأنه خرج من نجم ونجمه يعتبرهما الشباب مثلهم الأعلى ، ثم تكرار هذه الأفلام ، وغياب الوعي الديني في المدارس وندرته في البيوت ، وهجر الشباب للمساجد أفرز استحسانا ؛ ثم إصرارا ، ثم ممارسة فعلية حتى صارت ظاهرة تمثل 40% من الفتيات متزوجات عرفيا تقريبا..!!!!!
4- التهوين من أخلاقيات المجتمع وعرف العائلات ، وإيهام الفتيات أن شرط الزواج الوحيد هو وجود الحب ، وبالتالي فلا بد من التجربة لاكتشاف الحب ، وحين تصل الفتاة أن هذا وهم وأن ما يسمونه حبا ما هو إلا مخادنة مقيته تكون قد أضاعت أغلى ماتملك. ويتغافل الإعلام أن يقدم معني الحب الحقيقي من عفة وتضحية والمحافظة على المحبوب ، والبعد عن مواطن الشبهات ،بل يتعمد الإعلام عدم ذكر مسئوليات هذا الحب ،وحقيقته، وكيفية التغلب على عقباته بعد الزواج ..!! مما يتولد عنه صدمة كبيرة للطرفين بعد الزواج ، لأن أحدا ما علمه حقيقة المسئولية الأسرية .!!
5- فضبلا أنه ما علم حقيقة الحب بشموليته.! كيف يكون حبا وهو يخون صديقه مع أخته...؟! بل ربما مع زوجته....؟!!! ،كيف يكون حبا وهي تذبح والدها بسكين العار والخزي في أغلى ما يملك...؟!!! بعد سنوات مريرة من التربية والتعب والجد !!!! ويوم الحصاد يأتي الشيطان فيسلبه نور عينيه...!!!!!!!!
6- استطاع الإعلام متمثلا في الأفلام والفيديو كليب والمسلسلات في زعزعة العقيدة والمراقبة وقتل الضمير عند الكثير من الشباب فسقطوا في براثن الإدمان أو التطرف أو العنف أو الإنحلال الخلقي أو الزنا العرفي ..!!!!!! وما عرفت مجتماعاتنا الإسلامية هذا من قبل ..!

الفصل الثاني

المبحث الأول

حكم تزويج المرأة لنفسها بغير ولي

تمهيد

قبل الخوض في بيان حكم الزواج العرفي أحب أن ألفت الإنتباه إلى أمر مهم :
هوأن هذا الزنا العرفي يفتقر إلى شروط أساسية لصحة العقد؛ منها إذن الولي وعلمه ؛ ومنها حضور الشهود وإعلان النكاح؛ وعدم التواطوء على كتمانه ، وهذا هو ما سنتعرض له بإذن الله بالدراسة الفقهية لعرض أقوال العلماء فيها ؛ وإزالة اللبس فيما يُشاع بين الشباب وكان سببا لانتشاره هذا الزنا بينهم باسم الزواج .!ومنها
1- اعتقادهم أن الحنفية يرون صحة العقد بغير ولي يفهمون بغير إذنه ورضاه وليس هذا قصدهم كما سنرى بإذن الله.
2- اعتقادهم أن المالكية يجيزون النكاح بغير شهود بل ويتبجحون فينقلون ذلك عن ابن تيمية رحمه الله وما فهموا مرادهم كما سنرى بإذن الله.

فحين نتتبع أقوال العلماء نجد أن في المسألة عدة أقوال بين من يشترط الولي كالجمهور وبين من لا يشترطه لكن يجيز للولي فسخه إن كان بغير كفؤ ( كأبي حنيفة , وزفر) وبين من يوقفه علي إجازة الولي(كالقاسم بن محمد والحسن)، ومن يشترط الزواج بالكفؤ ( كالأوزاعي ) .
لكنها في النهاية تتلخص في قولين :
القول الأول :أنه لا يجوز للمرأة أن تزوج نفسها بغير ولي وهذا قول الجمهور روي عن عمر وعلي وابن مسعود وابن عباس وأبي هريرة وعائشة رضي الله عنهم وإليه ذهب سعيد بن المسيب والحسن وعمر بن عبد العزيز وجابر بن زيد والثوري وابن أبي ليلى وابن شبرمة وابن المبارك وعبيد الله العنبري والشافعي وإسحاق وأبو عبيد وأحمد وابن حزم والزيدية[1]و أطفيش[2] ابن تيمية
القول الثاني : يجوز أن تتولي المرأة زواجها بنفسها وهذا قول أبو حنيفة وزفر والشعبي والزهري[3]والإمامية[4]

المطلب الأول : أدلة الجمهور

أولا : من القرآن

الدليل الأول : قوله تعالى : { وأنكحوا الأيامى منكم ، والصالحين من عبادكم وإمائكم}[5]
وجه الدلالة
أن الآية بيان في أن نكاحهن لا يكون إلا بإذن الولي ، فالخطاب موجه للأولياء.
يقول الشيخ محمد أبو زهرة ( ... ، وهو نص في إحداث عقد النكاح فقد أضيف في هذه الآية ومثيلاتها إلي الأولياء وهو نص في إحداث عقد الزواج[6]
الدليل الثاني : قوله تعالى { وَلا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلأمَةٌ مُؤْمِنَةٌ خَيْرٌ مِنْ مُشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ }[7]
وجه الدلالة
في قوله تعالي : { وَلا تَنْكِحُوا الْمُشْرِكَاتِ .......وَلا تُنْكِحُوا الْمُشْرِكِينَ....}
أنه خطاب للأولياء أيضا؛ نقل ابن العربي عن محمد بن علي بن حسين : أنها دالة على النكاح بولي ، ثم قال ..وهي مسألة بديعة ودلالة صحيحة[8] .
الدليل الثالث : قوله تعالى :{ وَإِذَا طَلَّقْتُمْ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلَا تَعْضُلُوهُنَّ أَنْ يَنْكِحْنَ أَزْوَاجَهُنَّ إذَا تَرَاضَوْا بَيْنَهُمْ بِالْمَعْرُوفِ }
سبب النزول
يقول ابن كثير:
عن ابن عباس نزلت هذه الآية في الرجل يطلق امرأته طلقة أو طلقتين فتنقضي عدتها ثم يبدو له أن يتزوجها وأن يراجعها وتريد المرأة ذلك فيمنعها أولياؤها من ذلك فنهى الله أن يمنعوها .
ويقول الإمام القرطبي : فلا تعضلوهن أن ينكحن أزواجهن هذه الآية نزلت في معقل بن يسار إذ عضل أخته عن مراجعة زوجها قاله البخارى ولولا أن له حقا في الإنكاح ما نهى عن العضل)[9]
وجه الدلالة
فيها دلالة على أن المرأة لا تملك أن تزوج نفسها وأنه لابد في النكاح من ولي،حيث نهاه عن العضل ولو لم يكن للولي حق في ولاية النكاح وأنه الذي يعقد عقدة النكاح لما كان لنهيه معنى.
يقول الإمام الشافعي رحمه الله :( وهذا أبين ما في القرآن من أن للولي مع المرأة في نفسها حقا وأن على الولي أن لا يعضلها إذا رضيت أن تنكح بالمعروف)[10]
ويقول الإمام الصنعاني : (...ودلت أيضا أن نسبة النكاح إليهن في الآيات مثل: (حتى تنكح زوجا غيره) مراد به الإنكاح بعقد الولي إذ لو فهم صلى الله عليه وسلم أنها تنكح نفسها لأمرها بعد نزول الآية بذلك لأبان لأخيها أنه لا ولاية له ولم يبح له الحنث في يمينه والتكفير[11]

الدليل الرابع :قوله تعالي: { فَلَمَّا قضى زَيْدٌ مِّنْهَا وَطَراً زَوَّجْنَاكَهَا لِكَيْ لاَ يَكُونَ عَلَى المؤمنين حَرَجٌ في أَزْوَاجِ أَدْعِيَآئِهِمْ إِذَا قَضَوْاْ مِنْهُنَّ وَطَراً وَكَانَ أَمْرُ الله مَفْعُولا }[12]فقد روي البخاري بسنده عن زيد بن ثابت عن أنس أن زينب كانت تفخر على أزواج النبي صلى الله عليه وسلم تقول زوجكن أهاليكن وزوجني الله تعالى من فوق سبع سماوات[13]. وفي المستدرك :(زوجني الله وزوجكن أهاليكن ؛زوجني الله من رسوله وزوجكن آباؤكن وأقاربكن)[14]
وجه الدلالة
قولها :زوجكن أهاليكن وزوجني الله عز وجل من فوق سبع سموات . يقول ابن حزم : ( فهذا إسناد صحيح مبين أن جميع نسائه عليه السلام إنما زوجهن أولياؤهن حاش زينب - رضي الله تعالى عنها - فإن الله تعالى زوجها لنبيه عليه الصلاة والسلام
الدليل الخامس:قال تعالى حكاية عن شعيب في قصة موسى عليهما السلام:( قَالَ إِنِّي أُرِيدُ أَنْ أُنْكِحَكَ إِحْدَى ابْنَتَيَّ هَاتَيْنِ عَلَى أَنْ تَأْجُرَنِي ثَمَانِيَ حِجَجٍ فَإِنْ أَتْمَمْتَ عَشْرًا فَمِنْ عِنْدِكَ وَمَا أُرِيدُ أَنْ أَشُقَّ عَلَيْكَ سَتَجِدُنِي إِنْ شَاءَ اللَّهُ مِنَ الصَّالِحِينَ[15] }
وجه الدلالة
قوله تعالي (إنى أريد أن أنكحك ) فيها دليل على أن النكاح إلى الولي لا حظ للمرأة فيه، لأن صالح مدين تولاه.[16]
الدليل السابع: قوله تعالى :{ فانكحوهن بِإِذْنِ أَهْلِهِنَّ وَآتُوهُنَّ أُجُورَهُنَّ }[17]
وجه الدلالة
لم يخاطب تعالى بالنكاح غير الرجال، ولو كان إلى النساء لذكرهن.
ومن السنة
الدليل الأول
عن أبى بردة بن أبى موسى عن أبيه رضى الله تعالى عنهما قال : قال رسول الله صلى الله عليه وسلم :
" لا نكاح إلا بولى "[18] . وما ورد في هذا المعني
حديث ابن عباس أن رسول الله صلى الله عليه وسلم قال :لا نكاح إلا بإذن ولى مرشد أو سلطان[19].
وحديث جابر أن رسول الله صلى الله عليه وسلم قال : لا نكاح إلا بولي وشاهدي عدل[20].
وجه الدلالة
أن النبي صلي الله عليه وسلم نفي صحة عقد النكاح إلا بحضور الولي ورضاه لأن الأصل في النفي نفي الصحة لا الكمال لذا يقول الأمام الصنعاني:
والحديث دل على أنه لا يصح النكاح إلا بولي لأن الأصل في النفي نفي الصحة لا الكمال ، والولي هو الأقرب إلى المرأة من عصبتها دون ذوي أرحامها[21] .
اعتراض
الأحاديث تحتمل تأويلات متعددة فيحتمل ما ذكرتم من نفي صحة عقد النكاح ويحتمل أن يكون الولي هو الذي إليه ولاية البضع من والد الصغيرة أو مولى الأمة أو بالغة حرة لنفسها فيكون ذلك على أنه ليس لأحد أن يعقد نكاحا على بضع الأولى ذلك البضع وهذا جائز في اللغة كما قال الله تعالى:( فليملل وليه بالعدل) فقال قوم ولي الحق هو الذي له الحق فإذا كان من له الحق يسمى وليا كان من له البضع أيضا يسمى وليا له. فلما أحتمل هذه التأويلات انتفى أن يصرف إلى بعضها دون بعض إلا بقرينة تدل على ذلك إما من كتاب وإما من سنة وإما من إجماع[22]
- حديث لا نكاح إلا بولي لا يعترض على موضع الخلاف ؛ لأن هذا عندنا نكاح بولي ؛ لأن المرأة ولي نفسها كما أن الرجل ولي نفسه ؛ لأن الولي هو الذي يستحق الولاية على من يلي عليه ، والمرأة تستحق الولاية والتصرف على نفسها في مالها فكذلك في بضعها[23]
الجواب
إن خطاب الشارع لا يُوَجَّه إلا إلى الأغلب الأشهر من معانيه عند العرب، إلا أن تقوم حجة على شيء منه بخلاف ذلك فيسلم لها وولاية الرجل للمرأة في مباشرة عقد النكاح كانت معروفة عند العرب والصحابة حتى قبل الاسلام ،ومما يؤكد هذا حديث عائشة الآتي حيث قالت : ( يخطب الرجل إلى الرجل وليته أو ابنته..) وحديث أم سلمة الآتي حيث قالت : (..وليس أحد من أوليائي شاهد) ولو كانت كما تزعمون ما قالت أمهات المؤمنين ما قلنه.
الدليل الثاني
حديث عروة عن عائشة أنها أخبرته أن النكاح في الجاهلية كان على أربعة أنحاء منها نكاح الناس اليوم يخطب الرجل إلى الرجل وليته أو ابنته فيصدقها ثم ينكحها ثم قالت في آخره فلما بعث محمد صلي الله عليه وسلم بالحق هدم نكاح الجاهلية كله إلا نكاح الناس اليوم[24]
وجه الدلالة
أنه صلى الله عليه وآله وسلم قرر ذلك النكاح المعتبر فيه الولي وزاده تأكيدا بالأحاديث الآتية .
وفي قولها ( يخطب الرجل إلى الرجل وليته أو ابنته..) بيان أنه كان مشهورا عند العرب مكانة الولي في مباشرة عقد النكاح وحين خاطبهم النبي بقوله لا نكاح إلا بولي كان يخاطبهم بما يعرفونه من معني الولى بعمومه وهو : مَنْ يقوم بتحمل المسئولية والوِلايَة والتزويج
الدليل الثالث : عن ابن عباس قال قال رسول الله صلى الله عليه وسلم : ( أيما أمرأة تزوجت بغير اذن ولى فنكاحها باطل فنكاحها باطل ، فان دخل بها فلها المهر بما استحل من فرجها والسلطان ولى من لا ولى له[25].
وجه الدلالة
هذا من أصرح الأدلة في بيان بطلان وفساد إنكاح المرأة لنفسها بغير علم الولي وأذنه .
اعتراض
أن ابن علية روى عن ابن جريج أنه سأل الزهري عن هذا الحديث فقال لا أعرفه ،بل روي أن معمر قال :سألت الزهري عن الرجل يتزوج بغير ولي ؟ فقال : إن كان كفؤا لها لم يفرق بينهما . قالوا : فلو صح هذا الخبر بنسيان الزهري للرواية وفتواه بما يخالفها فإن هذا يوهن الرواية ويضعفها، لإن فتوى الراوي بخلاف الحديث دليل وهن الحديث[26]
الجواب
أولا : قد صح وثبت بروايات الأئمة الأثبات سماع الرواة بعضهم من بعض فلا تعلل هذه الروايات بحديث بن علية وسؤاله بن جُرَيْجٍ عنه[27] .
ثانيا: صح أن سماع ابن علية من ابن جريج غير ثابت ، فقد سُئل الإمام أحمد بن حنبل عن هذا فقال : أن بن جريج له كتب مدونة وليس هذا في كتبه يعني حكاية بن علية عن بن جريج [28]
ثالثا : علي فرض أنه قد صح قول الزهري لم أعرفه؛ وأن سليمان بن موسى نسيه؛ فليس فيه حجة
فقد صح أن رسول الله صلى الله عليه وآله وسلم نسي آية من القرآن . وقد قال عز وجل : { ولقد عهدنا إلى آدم من قبل فنسي . وقال ابن حبان : ليس هذا مما يقدح في صحة الخبر لأن الضابط قد يحدث ثم ينسى فإذا سئل عنه فلا يكون نسيانه دالا على بطلان الخبر وقال الحاكم نحو ذلك [29]
الدليل الرابع:حديث أبي هريرة أن النبي صلي الله عليه وسلم قال :( لا تزوج المرأة المرأة ، ولا تزوج المرأة نفسها ، فان الزانية التي تزوج نفسها)[30] .
وجه الدلالة
يقول الإمام الصنعاني: وفيه دليل أن المرأة ليس لها ولاية في الإنكاح لنفسها ولا لغيرها فلا عبرة لها في النكاح إيجابا ولا قبولا فلا تزوج نفسها بإذن الولي ولا غيره ولا تزوج غيرها بولاية ولا بوكالة ولا تقبل النكاح بولاية ولا وكالة.[31]
اعتراض
أولا: هذا محمول على وجه الكراهة لحضور المرأة مجلس العقد ؛ لأنه مأمور بإعلان النكاح ، ولذلك يجمع له الناس ، فكُره للمرأة حضور ذلك المجمع .
ثانيا : (روي في حديث آخر عن أبي هريرة هذا الحديث ، وذكر فيه أن أبا هريرة قال : ( كان يقال الزانية هي التي تنكح نفسها ) فهو من كلام أبي هريرة
ثالثا : لم يقل أحد من المسلمين أن تزويجها نفسها زنا ، لأن من لا يجيزه إنما يجعله نكاحا فاسدا يوجب المهر والعدة ويثبت به النسب إذا وطئ .
الجواب
أولا : أنه محمول علي الكراهة قول بلا دليل
ثانيا : أما قولكم أنها من كلام أبي هريرة فمختلف فيه وعلي فرض صحة قولكم فليس هو محل الشاهد
ثالثا : لا يقصد قائل هذه الكلمة حقيقتها وإنما هو بيان لشناعة فعل من تزوج نفسها بغير ولي فهي تشابه الزانية ، كحديث المتعطرة .
الدليل الخامس: قوله صلى الله عليه وآله وسلم : ( الثيب أحق بنفسها من وليها) وفي رواية (الثيب أحق بنفسها من وليها ، و البكر يستأذنها أبوها في نفسها و إذنها صماتها[32]
وجه الدلالة
إنه أثبت حقا للولي كما يفيده لفظ (أحق) وأحقيته هي الولاية وأحقيتها رضاها فإنه لا يصح عقده بها إلا بعده فحقها
بنفسها آكد من حقه لتوقف حقه على إذنها[33]
الدليل السادس :عن هشام بن عروة عن أبيه قال : قالت عائشة : تزوجني رسول الله صلى الله عليه وسلم وأنا ابنة ست سنين بمكة ودخل بي وأنا ابنة تسع سنين بالمدينة[34]
وجه الدلالة
يقول الإمام الشافعي : دل إنكاح أبي بكر عائشة النبي صلى الله عليه وسلم ابنة ست وبناؤه بها ابنة تسع على أن الأب أحق بالبكر من نفسها ولو كانت إذا بلغت بكرا كانت أحق بنفسها منه أشبه أن لا يجوز له عليها حتى تبلغ فيكون ذلك بإذنها[35]
الدليل السابع: حديث حفصة حين تأيمت وعقد عمر عليها النكاح ولم تعقده هي.[36]
وجه الدلالة
يقول الطبري:فيه إبطال قول من قال: إن للمرأة البالغة المالكة لنفسها تزويج نفسها وعقد النكاح دون وليها، ولو كان ذلك لها لم يكن رسول الله صلى الله عليه وسلم ليدع خِطبة حفصة لنفسها إذا كانت أولى بنفسها من أبيها، وخطبها إلى من لا يملك أمرها ولا العقد عليها [37]
الدليل الثامن:قصة زواجه صلى الله عليه وآله وسلم من أم سلمة[38] .فعن أم سلمة قالت :لما انقضت عدتها بعث إليها أبو بكر يخطبها عليه فلم تزوجه فبعث إليها رسول الله ( صلى الله عليه وسلم ) عمر بن الخطاب يخطبها عليه فقالت : أخبر رسول الله ( صلى الله عليه وسلم ) أني امرأة غَيْرى وأني امرأة مُصْبية وليس أحد من أوليائي شاهد فأتى رسول الله ( صلى الله عليه وسلم ) فذكر ذلك له فقال : ارجع إليها فقل لها : أما قولك : إني امرأة غيري فسأدعو الله لك فيذهب غيرتك وأما قولك : إني امرأة مصبية فستكفين صبيانك وأما قولك : أن ليس أحد من أوليائي شاهد فليس أحد من أوليائك شاهدا ولا غائب يكره ذلك فقالت لابنها : يا عمر قم فزوج رسول الله ( صلى الله عليه وسلم ) فزوجه "[39]
وجه الدلالة
قولها إنه( ليس أحد من أوليائها شاهد ) فلم يقل صلى الله عليه وآله وسلم ( أنكحي أنت نفسك )مع أنه مقام البيان[40]
الدليل التاسع : قصة زواجه بميمونة. فعن عكرمة عن ابن عباس ثم أن رسول الله صلى الله عليه وسلم بعث محمية بن جزء ورجلين آخرين إلى ميمونة يخطبها وهي بمكة فردت أمرها إلى أختها أم الفضل فردت أم الفضل إلى العباس فأنكحها رسول الله صلى الله عليه وسلم[41]
وجه الدلالة
أن مسألة الولاية في النكاح كانت معروفة واشتراط الولي يقرره إنكاح العباس للنبي ومضمون قول النبي
صلى الله تعالى عليه وسلم :( إذا أتاكم من ترضون دينه وخلقه فزوجوه ، إلا تفعلوه تكن فتنة في الأرض وفساد كبير ) فهو يخاطب الأولياء.
ومن الآثار
الآثار في هذا الباب كثيرة سنكتفي منها بهذه الباقة
1- عن أمنا عائشة رضي الله عنها، أنها كانت تُخطب إليها المرأة من أهلها فتشهد ، فإذا بقيت عقدة النكاح قالت لبعض أهلها : « زوج فإن المرأة لا تلي عقدة النكاح » وفي رواية فإذا لم يبق إلا النكاح قالت:« يا فلان أنكح ، فإن النساء لا ينكحن » ، وفي رواية أخرى قالت : « ليس إلى النساء النكاح[42] »
2- روي ابن وهب عن يونس أنه سأل ابن شهاب عن المرأة هل تلي عقدة نكاح مولاتها أو أمتها قال:
( لَيْسَ لِلْمَرْأَةِ أَنْ تَلِيَ عُقْدَةَ النِّكَاحِ إلَّا أَنْ تَأْمُرَ بِذَلِكَ رَجُلًا)[43]
3 - روي الإمام الشافعي بسنده عن عكرمة بن خالد قال ثم جمعت الطريق رفقة فيهم امرأة ثيب فولت رجلا منهم أمرها فزوجها رجلا فجلد عمر بن الخطاب رضي الله عنه الناكح و المنكِح ورد نكاحها[44]
وعمر جلدهما أدبا وتعزيرا، ولذلك جلد المنكح ولم يجلد المرأة وجلدهما بمجرد العقد مع اعتقادهما حله[45]
4 - وروي الإمام الشافعي بسنده عن عمرو بن دينار أن امرأة من بني بكر بن كنانة يقال لها بنت أبي ثمامة نكحت عمر بن عبد الله بن مضرس فكتب علقمة بن علقمة العتواري إلى عمر بن عبد العزيز إذ هو والى المدينة إني وليها وإنها نكحت بغير أمري فرده عمر وقد أصابها قال فأي امرأة نكحت بغير إذن وليها فلا نكاح لها[46]
5 - وروي الإمام الشافعي بسنده عن ابن سيرين عن أبي هريرة رضي الله عنه قال ثم لا تنكح المرأة المرأة فإن البغي إنما تنكح نفسها[47]
6 - عن محمد بن سيرين عن أبي هريرة قال ثم كنا نتحدث أن التي تنكح نفسها هي الزانية[48]
7 - روى ابن حزم بسنده أن الحسن سُئل عن امرأة خطبها رجل ووليها غائب بسجستان , ولوليها هاهنا ولي أيزوجها ولي وليها ؟ قال : لا , ولكن اكتبوا إليه , قلت له:إن الخاطب لا يصبر ؟ قال : فليصبر , قال له رجل : إلى متى يصبر ؟ قال الحسن:يصبر كما صبر أهل الكهف[49]
8 - روى الدراقطني بإسناده عن الشعبي قال ما كان أحد من أصحاب النبي صلى الله عليه وسلم أشد في النكاح بغير ولي من علي رضي الله عنه كان يضرب فيه[50]
ومن المعقول
الدليل الأول : عظم خطر النكاح وعمق أثره،في حياة الرجل والمرأة ،فهو اللبنة الأولي في بناء المجتمعات والأمم والحضارات ، وهو مزج لأسرتين وانصهار عائلتين ،فبالنسبة للمرأة إما أن يجلب خزيا وخسة وإما أن يجلب شرفا وعزا ،فأسرة المرأة ينقصها أن تتزوج من وضيع خسيس ، لكنه بالنسبة للرجل لا ينقصه ولا ينقص أسرته أن يتزوج من هي أقل منه شرفا .نعم قد تتأثر الأسرة إذا تزوج بخضراء الدمن وقد يجر علي الأسرة عارا .لكنه ليس بقدر الفتاة ،ثم هو قادر علي مفارقتها متي شاء بخلاف الفتاة !!
الدليل الثاني : حرصا علي العلاقات الأسرية فلقد أوجب الشارع للزوج على زوجته الطاعة الكاملة ،فلو لم ترضي به أسرة المرأة فقد يؤدي للشقاق ، ويمنع الزوجة من زيارة أقاربها ، وعليها الطاعة فماذا تفعل ؟
الدليل الثالث :إن معرفة أحوال الرجال ، ومكنون نفوسهم ، وخفايا شئونهم لا تتم إلا بالممارسة والمخاطبة ، وتقصي أحوالهم والاتصال بهم ، ومعرفة كفاءتهم للمرأة في الزواج تستدعي كل هذا ،وهي لا تتم للمرأة التي تقر في بيتها ، وتكن إلي أهلها، ولا تتوافق مع طبيعتها وغلبة العاطفة عليها ، ورقة خلقتها (أَوَمَنْ يُنَشَّأُ فِي الْحِلْيَةِ وَهُوَ فِي الْخِصَامِ غَيْرُ مُبِينٍ[51] وسرعة تأثرها ، فحتي التي تخرج للتعليم وللعمل ، وتختلط مع الرجال ، وتخرج لقضاء حوائجها ، قد تكتسب بعض الخبرة لكنها بغير القدر الكافي ، ثم أن هذه الخبرة قد تتأخر فيكون ثمنها عار لن تمحيه السنين ، ولن يتوقف عندها وحدها، وقد يكون فقدان عذريتها وتحملها مسئولية أولاد ألقاهم أبوهم في الطريق ، وأقل ما سوف تجنيه هو تخلي أوليائها عنها ، وتبرئهم منها لأنها سلبتهم حق المشورة والنصح .وكفتهم مؤنة تحمل المسئولية معها .
الدليل الرابع :استدل بعض الفقهاء بأن المرأة ناقصة عقل ، يقول ابن قدامة :( ....ولأن المرأة إنما منعت الاستقلال بالنكاح لقصور عقلها فلا يؤمن انخداعها ووقوعه منها على وجه المفسدة وهذا مأمون فيما إذا أذن فيه وليها[52]
اعتراض
أن اختيار الزوج أهم من مباشرة العقد وقد وكل إليها، واعتبر صحة إقرارها بالنكاح واعتبر رضاها في مباشرة الولي العقد فعد هذا إقرارا من الشارع بأهليتها الكاملة .
الجواب
نقر بما ذكرتم لكننا نقول أن الشريعة الإسلامية رغم أنها أعطت المرأة من الأهلية- سواء أكانت أهلية وجوب أم أهلية أداء – ما تعطيه الرجل ، فهما سواء (إنما النساء شقائق الرجال)إلا أن جمهور العلماء مع الإقرار بهذه الأهلية الكاملة فليست لها الحرية المطلقة في الزواج فلها أن تختار من تشاء من الأزواج لكن ليس لها أن تنفرد في ذلك بل تشترك مع وليها حرصا علي سلامة اختيارها ،ودفعا لضرر لن يلحقها وحدها ، وتكريما لها وإكراما لحفظ حيائها ،وصيانة لها أن تتحول إلى حقل تجارب

Kindness to a Non-Muslim Neighbor

The neighbor holds a special status in Islam. Islam encourages Muslims to treat their neighbors in a gentle way that reflects the true and genuine spirit of Islam as exemplified in its tolerant aspect especially with people of other faiths. It makes no difference whether the neighbors are Muslim or non-Muslim. Ayesha, the Mother of the Believers, stated that she once asked the Prophet Muhammad (peace and blessings be upon him), "O Messenger of Allah! I have two neighbors. To whom shall I send my gifts?" the Prophet Muhammad (peace and blessings be upon him) said, "To the one whose gate is nearer to you."
It is clear from the above Prophetic Hadith that Muslims are encouraged to not only treat our neighbors kindly, but also to exchange gifts with them. The wording of the Hadith does not indicate whether the one with whom we exchange gifts is a Muslim or not.
Below are ten tips on how to approach your non-Muslim neighbors in a kind way that exemplifies Islamic manners:
1. Being good to neighbors is not only restricted to those who share the same building with you. Your roommate at the dorm is your neighbor; the person sitting behind you or next to you in a bus or at a bus stop is your neighbor; the one sharing your office at work is your neighbor; the person enjoying fresh air next to you in a public garden is also a neighbor. You ought to treat all of those people kindly and socialize with them within the permitted scope of Shariah Islamic Law.
2. Introduce yourself and your family to your neighbors when you move into a new place or when new neighbors move in. This will also help to relieve any fears or tensions they may have about Muslims. Also, don't forget to say good-bye when you or they move away.
3. Care for them continually, especially at times of need and distress, as "the neighbor in need is a neighbor indeed." If a neighbor is elderly or chronically ill, offer to run errands or shop for him or her.
4. In dealing with neighbors, it is safer to deal with those of the same sex as yourself. This does not mean that you should stop socializing at work or school with your non-Muslim workmates or classmates of the opposite sex, but be aware of satanic snares. After-hours socializing should be with your same sex.
5. While socializing with non-Muslims, be cautious of becoming too lenient at the expense of your creed and principles. For example, don't go out drinking with them. They will respect you more for sticking to your principles than for breaking the rules.
6. In addition to sharing ideas, you can share meals with them by inviting them to dinner on the weekend or accepting their invitation to the same, provided that you let them know about your dietary restrictions (Halal and Haram) as a Muslim.
7. Conduct mutual visits so that the families can interact in a constructive way. If the discussion does turn to religion, focus on areas of common ground. For example, if your neighbors are Christian, then you should not enter into a futile argument with them about whether Jesus is God incarnate or not. Rather, tell them to what extent Islam honors all God's Prophets and Messengers as a whole, and that Jesus is granted a special status among God's Prophets and Messengers.
8. While socializing with neighbors, present your religion (Islam) in the best way. If you are faced with a difficult question or a distortion about Islam, do not be ashamed to stop for a while and tell them that you will try to contact a more knowledgeable person to seek the guidance regarding the issue raised. Thus, common grounds should be enhanced, and areas of dissension should never be raised.
9. If your neighbors show an interest in Islam, invite them to attend Islamic events, and even to accompany you to the mosque to see what it is like. It may be that their hearts become softened to Islam, and if they remain non-Muslim, at least you have succeeded in breaking the barrier. You can also visit the church where your neighbors pray if they invite you to do that, but here you should be cautious not to perform any act that your religion prohibits. In brief, be only a watchful monitor.
10. Always keep in mind the mighty reward that is in store for you in the Hereafter when you show kindness to a neighbor.

من التقاليد في بعض الجامعات أن يجتمع الخريجون ويعودون إليها بين الحين والآخر في لقاءات لم شمل ويتعرفون على أحوال بعضهم البعض ، من نجح وظيفيا ومن تزوج ومن أنجب…. الخوفي إحدى تلك الجامعات ، التقى بعض خريجيها في منزل أستاذهم العجوز ، بعد سنوات طويلة من مغادرة مقاعد الدراسة ، وبعد أن حققوا نجاحات كبيرة في حياتهم العملية ، ونالوا أرفع المناصب وحققوا الاستقرار المادي والاجتماعي ، وبعد عبارات التحية والمجاملة ، طفق كل منهم يتأفف من ضغوط العمل ، والحياة التي تسبب لهم الكثير من التوتر ، وغاب الأستاذ عنهم قليلا ، ثم عاد يحمل أبريقا كبيرا من القهوة، ومعه أكواب من كل شكل ولون ، أكواب صينية فاخرة ، وأكواب ميلامين ، وأكواب زجاج عادية ، وأكواب بلاستيك ، وأكواب كريستال ، فبعض الأكواب كانت في منتهى الجمال تصميماً ولوناً وبالتالي كانت باهظة الثمن ، بينما كانت هناك أكواب من النوع الذي تجده في أفقر البيوت ، حينها قال الأستاذ لطلابه :تفضلوا ، و ليصب كل واحد منكم لنفسه القهوة ، وعندما بات كل واحد من الخريجين ممسكا بكوب تكلم الأستاذ مجددا، هل لاحظتم ان الأكواب الجميلة فقط هي التي وقع عليها اختياركم ؟ وأنكم تجنبتم الأكواب العادية ؟ومن الطبيعي أن يتطلع الواحد منكم إلى ما هو أفضل ، وهذا بالضبط ما يسبب لكم القلق والتوتر، ما كنتم بحاجة إليه فعلا هو القهوة وليس الكوب !ولكنكم تهافتم على الأكواب الجميلة الثمينة ، و بعد ذلك لاحظت أن كل واحد منكم كان مراقباً للأكواب التي في أيدي الآخرين ، فلو كانت الحياة هي القهوة ، فإن الوظيفة والمال والمكانة الاجتماعية هي الأكواب ، وهي بالتالي مجرد أدوات ومواعين تحوي الحياة ، ونوعية الحياة (القهوة) تبقى نفسها لا تتغير،و عندما نركز فقط على الكوب فأننا نضيع فرصة الاستمتاع بالقهوة ، وبالتالي أنصحكم بعدم الاهتمام بالأكواب والفناجين ، وبدل ذلك أنصحكم بالاستمتاع بالقهوة !في الحقيقة هذه آفة يعاني منها الكثيرون ، فهناك نوع من الناس لا يحمد الله على ما هو فيه مهما بلغ من نجاح لأنه يراقب دائما ما عند الآخرين .وهنا يأتي دور القناعة

Abu al-'Abbas 'Abdullah bin 'Abbas, radiyallahu anhuma, reported: One day I was behind the Prophet, sallallahu 'alayhi wasallam, and he said to me:
"O young man, I shall teach you some words [of advice] : Be mindful of Allah, and Allah will protect you. Be mindful of Allah, and you will find Him in front of you. If you (have need to) ask, ask of Allah; and if you seek help, seek help from Allah. Know that even if the Nation (or the whole community) were to gather together to benefit you with something, they would not benefit you with anything except that which Allah has already recorded for you, and that if they gather together to harm you with something, they would not be able to harm you with anything except that which Allah has already recorded against you. The pens have been lifted and the pages have dried."
There are a few key issues we must understand in regards to this hadith1- If we are mindful of Allah, we will find Him close to us or beside us or in front of us. Allah is close to His servants (the mua'minin) by giving them guidance, support, help, protection, victory, etc.The other narration of this hadith states that if we become beloved to Allah during times of ease, He will know us during times of hardship. During our times of ease or prosperity, if we use it for the pleasure of Allah, He will be with us to look after us in our times of hardship, weakness, sickness, etc. Even in terms of receiving reward from Allah

1- The statement in which the Prophet, sallallahu 'alayhi wasallam, tells 'Abdullah bin Abbas to "ask of Allah" and to "seek help from Allah" is the fundamental basics of Tawhid. This is something we say in every salah ("iyya ka na'budu wa iyya ka nasta'in"). This shows us the importance of du'a, the importance of continuously asking Allah for His support and guidance. We need to show our need for Allah and our total dependency on Him by performing such forms of ibadah.
2-If we are "mindful of Allah", i.e. we observe and fulfil His obligations/commandments, "Allah will protect us". There two kinds of protection from Allah:Allah will protect or look after His servants in this world / in worldly matters. For example, our health and our senses. We will be enjoying Allah's mercy and bounty for our sight, hearing and speech all of our lives – even as we grow old, Allah will still allow us to see and hear properly, or he will take care of our intellect and mental health.
Another example is Allah will protect our family and our property, belongings and money. Also, if one is mindful of Allah during his youth, Allah will protect him during his adult years.Allah will protect His servants' deen (religion) and iman (faith). He will protect us from misunderstandings and being misled or influenced by misconceptions and self-desires. He will help us and give us guidance so that we are protected from negative influence.

3- The phrase "Be mindful of Allah" means:To observe or fulfil Allah's obligations To adhere to His commandments To avoid His prohibitions Some of the things we have to fulfil - to attain Allah's protection - include:
The daily prayers (salah) – by praying in the best way we can and by performing it on time. Maintaining cleanliness and purity. Observing our oath – we have to be careful if we swear by Allah that we will do something, because we have to abide to this commitment we make. Guarding our senses – we should ensure that what we see or hear or say pleases Allah. We should fear Allah and not use these senses in the wrong manner. Ensuring that we do not consume, via food or drink, anything that is not halal. Observing that our dealings and transactions are halal. Protecting our hearts from being involved in maksiah, e.g. zina' (adultery) – the moment a person is weak and does a maksiah, he should repent because of his fear of Allah.

فضل شـهر الله المُحرَّم وصيام عاشـوراء
الحمد لله ،والصلاة والسلام على من لا نبي بعده
وبعد:

فإن شـهر الله المُحرَّم شـهر عظيم مبارك، وهو أول شـهور السـنـة الهجريـة وأحد الأشـهر الحُرُم التي قال الله تبارك وتعالى فيها: {{ إِنَّ عِدَّةَ الشُّـهُورِ عِنْدَ اللَّهِ اثْنَا عَشَـرَ شَـهْراً فِي كِتًابِ اللَّهِ يَوْمَ خَلَقَ السَّـمَوَاتِ وَالأَرْضَ مِنْهَا أَرْبَعَـةٌ حُرُمٌ ذَلِكَ الدِّينُ الْقَيِّمُ فَلا تَظْلِمُوا فِيهِنَّ أَنْفُسَـكُمْ ...}} ـ الآيـة 36 سـورة التوبـة.

وعن أبي بَكْرَةَ رضي الله عنـه عن النبي صلى الله عليـه وسـلم: "السـنـة اثنا عشـر شـهراً منها أربعـة حُرُمْ، ثلاثـة متواليـة: ذو القعدة وذو الحجـة والمحرم، ورجب مُضَرَ الذي بين جُمادى وشـعبان." ـ رواه البخاري 2958.
لماذا سمي شهر الله المحرم بهذا
والمُحرَّم سُـمي بذلك لكونـه شـهراً مُحرَّماً وتأكيداً لتحريمـه.

Fasting in Muharram - Ashoora & Taasoo'aa

The Sacred month of Muharram is one of the four sacred months. Abu Bakrah (RA) reported that the Prophet (SAW) said: “The year is twelve months of which four are sacred, the three consecutive months of Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram, and Rajab Mudar which comes between Jumaada and Sha’baan.” (Reported by al-Bukhaari, 2958).

The month of Muharram is the first month of the lunar year began this year on Sunday (Dec. 28, 2008. This blessed month was mentioned in the following hadith: Abu Hurairah reported: "I asked the Prophet: "Which prayer is best after the obligatory prayers?" He said: "Prayer during the middle of the night." I asked: "Which fast is best after the fast of Ramadhan?" He said: "Fasting during the month of Muharram." [Muslim].

When he migrated to Madeenah, he found the Jews celebrating this day, so he asked them why, and they replied "This is a great day. Allah saved Mousa (Moses) and the tribes of Israel from their enemies on this day and therefore Mousa fasted on it. "The Prophet said: "We have more of a right to Mousa than you." So he fasted on that day also and ordered the people to fast on that day." [al-Bukhari and Muslim].

Conditions of udhiyah
The animal should have reached the required age, which is six months for a lamb, one year for a goat, two years for a cow and five years for a camel.
It should be free of any faults, because the Prophet (peace and blessings of Allaah be upon him) said: “There are four that will not do for sacrifice: a one-eyed animal whose defect is obvious, a sick animal whose sickness is obvious, a lame animal whose limp is obvious and an emaciated animal that has no marrow in its bones .” (Saheeh, Saheeh al-Jaami’, no. 886). There are milder defects that do not disqualify an animal, but it is makrooh to sacrifice such animals, such as an animal with a horn or ear missing, or an animal with slits in its ears, etc. Udhiyah is an act of worship to Allaah, and Allaah is Good and accepts only that which is good. Whoever honours the rites of Allaah, this has to do with the piety (taqwa) of the heart.
It is forbidden to sell it. If an animal has been selected for sacrifice, it is not permissible to sell it or give it away, except in exchange for one that is better. If an animal gives birth, its offspring should be sacrificed along with it. It is also permissible to ride it if necessary. The evidence for this is the report narrated by al-Bukhaari and Muslim from Abu Hurayrah (may Allaah be pleased with him), who said that the Messenger of Allaah (peace and blessings of Allaah be upon him) saw a man leading his camel and told him, “Ride it.” He said, “It is for sacrifice.” He said, “Ride it” a second or third time.

It should be sacrificed at the specified time, which is from after the prayer and khutbah of Eid – not from when the time for the prayer and khutbah starts – until before sunset on the last of the days of Tashreeq, which is the 13th day of Dhu’l-Hijjah. The Prophet (peace and blessings of Allaah be upon him) said: “Whoever sacrifices before the prayer, let him repeat it.” (Reported by al-Bukhaari and Muslim). ‘Ali (may Allaah be pleased with him) said: “The days of Nahr (Sacrifice) are the day of al-Adhaa and the three days following it.” This is also the opinion of al-Hasan al-Basri, ‘Ata’ ibn Abi Rabaah, al-Oozaa’i, al-Shaafa'i and Ibn al-Mundhir, may Allaah have mercy on them all.
What should be done with the sacrifice?
It is mustahabb (liked, preferable) for the one who has made a sacrifice to not eat anything on that day before he eats from it, if this is possible, because of the hadeeth, “Let every man eat from his sacrifice.” (Classed as saheeh in Saheeh al-Jaami’, 5349). This eating should be after the Eid prayer and khutbah. This is the opinion of the scholars, including ‘Ali, Ibn ‘Abbaas, Maalik, al-Shaafa'i and others. The evidence for this is the hadeeth of Buraydah (may Allaah be pleased with him): “The Prophet (peace and blessings of Allaah be upon him) would not go out on the day of Fitr until he had eaten, and he would not eat on the day of Adhaa until he had slaughtered (his sacrifice).” (Al-Albaani said: its isnaad is saheeh. Al-Mishkaat, 1/452).
It is better for a person to slaughter the sacrifice himself, but if he does not, it is mustahabb for him to be present when it is slaughtered.
It is mustahaab to divide the meat into three: one third to be eaten, one third to be given as gifts and one third to be given in charity. This was the opinion of Ibn Mas’ood and Ibn ‘Umar (may Allaah be pleased with them). The scholars agreed that it is not permissible to sell anything from its meat, fat or skin. In a saheeh hadeeth, the Prophet (peace and blessings of Allaah be upon him) said: “Whoever sells the skin of his udhiyah, there is no udhiyah for him (i.e., it is not counted as udhiyah).” (Classed as hasan in Saheeh al-Jaami’, 6118). The butcher should not be given anything of it by way of reward or payment, because ‘Ali (may Allaah be pleased with him) said: “The Messenger of Allaah (peace and blessings of Allaah be upon him) commanded me to take care of the sacrifice and to give its meat, skin and raiment ( covering used for protection ) in charity, and not to give anything of it to the butcher as a compensation . He said, ‘We will give him something from what we have.’” (Agreed upon). It was said that it is permissible to give the butcher something as a gift, and that it is permissible to give some of it to a kaafir if he is poor or a relative or a neighbour, or in order to open his heart to Islam. INSHA'ALLAH Eid-ul-Adha will be on Monday December 8th. Ottawa Muslim Association(OMA) will be celebrating Eid prayers at the Ottawa Civic Center (1015 Bank Street) in the Aberdeen Pavilion. The Hall will open at 8:00and Eid prayers will start insha Allah at 9:00.

AS WE KNOW , that the virtue of these ten days is based on many things:

1- Allah swears an oath by them

2- The Prophet (peace and blessings be upon him) testified that these are the best days of this world, the prophet صلى الله عليه وسلم said "There are no days greater in the sight of Allah and in which righteous deeds are more beloved to Him than these ten days, so during this time recite a great deal of tahlil (saying: 'there is no god but Allah'), takbir and tahmid." (Reported by Ahmad)

3- These ten days include the Day of `Arafah, on which Allah perfected His religion. Fasting on this day will expiate for the sins of two years. These days also include the Day of Sacrifice, the greatest day of the entire year and the greatest day of Hajj, which combines acts of worship in a way unlike any other day.

وَاتّبَعُواْ مَا تَتْلُواْ الشّيَاطِينُ عَلَىَ مُلْكِ سُلَيْمَانَ وَمَا كَفَرَ سُلَيْمَانُ وَلَكِنّ الشّيْاطِينَ كَفَرُواْ يُعَلّمُونَ النّاسَ السّحْرَ وَمَآ أُنْزِلَ عَلَى الْمَلَكَيْنِ بِبَابِلَ هَارُوتَ وَمَارُوتَ وَمَا يُعَلّمَانِ مِنْ أَحَدٍ حَتّىَ يَقُولاَ إِنّمَا نَحْنُ فِتْنَةٌ فَلاَ تَكْفُرْ فَيَتَعَلّمُونَ مِنْهُمَا مَا يُفَرّقُونَ بِهِ بَيْنَ الْمَرْءِ وَزَوْجِهِ وَمَا هُم بِضَآرّينَ بِهِ مِنْ أَحَدٍ إِلاّ بِإِذْنِ اللّهِ وَيَتَعَلّمُونَ مَا يَضُرّهُمْ وَلاَ يَنفَعُهُمْ وَلَقَدْ عَلِمُواْ لَمَنِ اشْتَرَاهُ مَا لَهُ فِي الاَخِرَةِ مِنْ خَلاَقٍ وَلَبِئْسَ مَا شَرَوْاْ بِهِ أَنْفُسَهُمْ لَوْ كَانُواْ يَعْلَمُونَ

الّذِينَ قَالَ لَهُمُ النّاسُ إِنّ النّاسَ قَدْ جَمَعُواْ لَكُمْ فَاخْشَوْهُمْ فَزَادَهُمْ إِيمَاناً وَقَالُواْ حَسْبُنَا اللّهُ وَنِعْمَ الْوَكِيلُ * فَانْقَلَبُواْ بِنِعْمَةٍ مّنَ اللّهِ وَفَضْلٍ لّمْ يَمْسَسْهُمْ سُوَءٌ وَاتّبَعُواْ رِضْوَانَ اللّهِ وَاللّهُ ذُو فَضْلٍ عَظِيمٍ * إِنّمَا ذَلِكُمُ الشّيْطَانُ يُخَوّفُ أَوْلِيَاءَهُ فَلاَ تَخَافُوهُمْ وَخَافُونِ إِن كُنتُمْ مّؤْمِنِينَ

أَمْ يَحْسُدُونَ النّاسَ عَلَىَ مَآ آتَاهُمُ اللّهُ مِن فَضْلِهِ فَقَدْ آتَيْنَآ آلَ إِبْرَاهِيمَ الْكِتَابَ وَالْحِكْمَةَ وَآتَيْنَاهُمْ مّلْكاً عَظِيماً

وَأَوْحَيْنَآ إِلَىَ مُوسَىَ أَنْ أَلْقِ عَصَاكَ فَإِذَا هِيَ تَلْقَفُ مَا يَأْفِكُونَ * فَوَقَعَ الْحَقّ وَبَطَلَ مَا كَانُواْ يَعْمَلُونَ * فَغُلِبُواْ هُنَالِكَ وَانقَلَبُواْ صَاغِرِينَ * وَأُلْقِيَ السّحَرَةُ سَاجِدِينَ * قَالُوَاْ آمَنّا بِرَبّ الْعَالَمِينَ * رَبّ مُوسَىَ وَهَارُونَ

وَقَالَ فِرْعَوْنُ ائْتُونِي بِكُلّ سَاحِرٍ عَلِيمٍ * فَلَمّا جَآءَ السّحَرَةُ قَالَ لَهُمْ مّوسَىَ أَلْقُواْ مَآ أَنتُمْ مّلْقُونَ * فَلَمّآ أَلْقُواْ قَالَ مُوسَىَ مَا جِئْتُمْ بِهِ السّحْرُ إِنّ اللّهَ سَيُبْطِلُهُ إِنّ اللّهَ لاَ يُصْلِحُ عَمَلَ الْمُفْسِدِينَ * وَيُحِقّ اللّهُ الْحَقّ بِكَلِمَاتِهِ وَلَوْ كَرِهَ الْمُجْرِمُونَ
[يونس:79-81]
وَقُلْ جَآءَ الْحَقّ وَزَهَقَ الْبَاطِلُ إِنّ الْبَاطِلَ كَانَ زَهُوقاً

قَالُواْ يَمُوسَىَ إِمّآ أَن تُلْقِيَ وَإِمّآ أَن نّكُونَ أَوّلَ مَنْ أَلْقَىَ * قَالَ بَلْ أَلْقُواْ فَإِذَا حِبَالُهُمْ وَعِصِيّهُمْ يُخَيّلُ إِلَيْهِ مِن سِحْرِهِمْ أَنّهَا تَسْعَىَ * فَأَوْجَسَ فِي نَفْسِهِ خِيفَةً مّوسَىَ* قُلْنَا لاَ تَخَفْ إِنّكَ أَنتَ الأعْلَىَ * وَأَلْقِ مَا فِي يَمِينِكَ تَلْقَفْ مَا صَنَعُوَاْ إِنّمَا صَنَعُواْ كَيْدُ سَاحِرٍ وَلاَ يُفْلِحُ السّاحِرُ حَيْثُ أَتَىَ

Islam did not only focus on addressing the root causes of the concept of terrorism, but rather gave the true foundational solutions for such a cancer.
First of all: Let’s look at the main reasons behind extremism:
1. The emotional ego with the lack of knowledge at the same time: For example you will find a young individual who is in love with religion…then his love will take over and control him, may be in the wrong direction. From there this “blind” urge will force him to make extreme decisions. At this pint the code of conduct becomes distorted because of lack of understanding of the teachings of the religion….The first victim for this is the person himself. This happens by him putting restrictions and taboos on himself…in other words a lot of hardships, which he thinks is a way to come closer to Allah. But sooner he or she will reach the climax of the crisis by filing to find the true guidance of a true mentor or teacher, then the person will force his or her opinion on others. And when no support or guidance is available, a sad result takes place, which we suffer from nowadays, where there is a lot of conflict and blood shed.
One of them said “I fast all my life and I never break my fast”, the other said “I isolate my self from women and I never marry”, and the last said “I pray all night long and never sleep”. And here you find the prophet teaching them the moderate Islam by saying “As for me, I pray and sleep, I fast and break my fast, and also I do marry women.”, then the prophet concluded the matter by saying “this is my way (Sunnah), so whom ever keeps distance from it, he will not be considered one of us”.

2. Second reason is the loss of freedom/ the lack of brotherhood..
See, when there is loss of freedom, a lot of feelings and emotions will be kept inside one ’s self. As a result a lot of accumulations of false judgments about the “other” will be built. This is a direct result of the feeling of oppression and because of the “my way or the highway” type of attitude. The individual here trys to express him self through strange behavior, which its main purpose is to grab attention and to prove one’s point.

The Quran has given us an ultimate solution for this problem. If we reflect upon the teachings of the Quran and Sunnah, one will find firm and constant rules, to uplift suspension and to cut off any possibility of ill thoughts and actions. This allows more freedom in thinking and exploring.

The Quran teaches us through the verse “You have your religion and I have mine” –chapter Al-kaferoon-, the freedom of choice and belief. Not only that, but the Quran protects healthy communication by stating “There is no compulsion in religion”-chapter Al-baqarah-. It is forbidden in Islam to force others to enter the religion, that’s why the Quran speaks to the prophet S. and tells him “No body has the right to force others to become believers” –chapter Younis-.

Islam encourages healthy and fruitful dialogues and spreads the breath of brotherhood among the different people to actually shorten the gap between them. For example In chapter Aa’l-3emran , it is stated “Oh people of the book come to common terms as between us and you…”. Allah ordered us to do so with wisdom and beautiful preaching, the Quran states “Do not argue with the people of the book except with goodness...” –chapter Al-3ankaboot-, this is a gesture of emphasis on the importance of freedom of speech and also universal brotherhood and forgiveness.

! Fear Allaah as He should be feared, for whoever fears Him will receive His protection; whoever turns to Him in repentance will receive His guidance and pleasure; whoever humbles himself in His worship will be honoured by Him and whoever transacts honourably with Him will prosper.
Undoubtedly Youth is the most impressionable age. It means not only a soul saved, but a life saved too. It means that one’s best days can be dedicated to the glory of God. Allah will ask us about our age and about our youth

لا تزولا قدم عبد يوم القيامة حتى يسأل عن أربع عن عمره فيما أفناه وعن شبابه فيماأبلاه وعن ماله من أين اكتسبه وفيما أنفقه..
Allah promised the paradise for youth who devout their times and health for the sake of Allah

The message we are delivering here targets the role of the family (i.e. the parents) not the society.
As I mentioned at the first khutba that the most important reason behind the weakness of Muslim nations is the misunderstanding of Allah’s revelation.

Many parents called me asking about the solutions of their children’ problems
They are uncontrollable, naughty, involved in illegal activities, hooked up in obscene relationships.
Facing these problems in the west is very different from facing them back home in Egypt, for example, or, in Saudi Arabia, or in Pakistan, or in Lebanon, or in Somalia. What makes it different here? It is the culture. The moral matters are at stake here. So, I chose this topic to be the topic of my khutbah today, hoping to find answers and solutions to many problems which ail ?/burden and destroy many Islamic families in the west, in general and here in Canada in particular.

The family bears the responsibility of mishandling the sexual concerns of their teenagers, and even worse the parents many times, do not respect their children and ignore the fact that their children are no longer children; they are adults.

Adding insult to injury, the parents rely often on punishment to reform their children without realizing the bad consequences of punishment, or even without explaining the reason behind prohibitions.

We should not take family as the scapegoat, the youth also bear the responsibility of falling into the trap of cohabitation, Just imagine you daughter coming after school day with aboy and telling you dad……… I’m having a boyfriend (boyfriend and girlfriend), mistreatment of the technology especially the internet which once was a blessed tool for knowledge, now it is a curse. Teenagers log into the internet to watch porn or (engage in illegal acquaintances) get involved with unknown people.
sometimes a young girl gets involved in dating online and she doesn’t even know the persons she is speaking with

If we want to understand our future we should learn from our past , our history and our religion
So let us know The Prophetic method in dealing with sexual matters with youth:
A young man came to the Prophet (SAWS) and asked him permission fornication to having sex with a woman. The companions were angry at him, while the Prophet (SAWS) remained calm. It was narrated that the Prophet (SAWS) asked the young man if he would approve this fornication to be committed upon his mother. The young man replied negatively, then he (SAWS) asked him if he would accept it to his sister, and again the young man replied with a big no, then the Prophet (SAWS) asked him if he would approve it to his aunt. The young man replied with a no once more. The Prophet (SAWS) told him that people would deny this exactly as he did. Then the Prophet (SAWS) invocated Allah (SWT) to grant this young man strength and guidance.
Notice that the Prophet (SAWS) did not humiliate or scold the young man but he rather taught him in a gentle calm way.
There are few main points that parents should communicate to their sons and daughters:
From this Hadith, we can consider our prophet the founder of a new theory in education of the youth; he advocates the principle of holding yourself accountable of your misdeeds and considering that you can be the victimized because of other one wrong doings. The prophet puts the oppressor in the shoes of the victim, the prophet puts you in the spot...for just a second…This is like the musical chairs, what if you're in this place, what is you're in this spot...what if your mother or sister is the victim.
The prophet doesn’t want the youth to rely on direct guidance, on the contrary, he صلى shows the negative effects of the wrong doings, and then he left the youth to himself/ or herself….this goes in concert with the nature of the rebellious nature of the youth, the prophet also instills in the youth the ability of taking the right decision independently, with his guidance to the right path.

To sum up ,thera are many points to ponder in the intrect relationship between teenagar and their parents
1- Sex is not a game but is sacred and honorable with noble goals.
2- Sexual harassment leads to falling into complete sex.
3- having sex without marriage is highly despised and leads to Allah's Wrath.
4- Involvement in illegitimate sex has destructive consequences on the future of the adolescents and causes incurable damage in his/her personality.
The right way is that parents should talk with their kids and bring up the issue gradually. The talk should flow in proper, calm, respectable and friendly emotional manner. They should also make brainstorming with their kids as a means to get the kids involved in reaching the right solutions.

Respectable guests,
I would like to express my happiness, of being here among you, in the beautiful Saint Luke's church. I was happy to receive the e-mail of Her Eminence, Reverend Barbara Maynard, and I wish that in the future we can get together, in many mutual meetings like this.
I logged on the website of Saint Luke's church, and found the page of Her Eminence, Reverend Barbara Maynard, and I was happy to find that, we both have studied English literature ,,, that is a point of convergence that should be taken into consideration. The study of the English Literature was the first encounter, which drew me close to the understanding of the Christian religion. I remember my Professor, back in Egypt, prof. Ahlam Fathi. She taught us THE SCARLET LETTER by Nathaniel Hawthorn
which abounds with Christian teachings, about the concepts of redemption, sin and adultery. This was my first real introduction to many concepts, which I was surprised to find them in Islam.
I thought of the many points of convergence between the two religions, and what is better than to cite the Nobel Quran in which Allah says: " O People, We have created you all male and female and have made you nations and tribes so that you would recognize each other. The most honourable among you in the sight of Allah is the most pious of you. Allah is All-knowing and All-aware."
All religions are from one origin, so where does the conflict come from? Muslims accept Jesus Christ, and Moses, and I just wonder at the negative reaction over the cartoon row about our holy prophet, of course, fanaticism exists in both sides which is a bad symptom of the one-sided view. And do you know what did I tell my people back home about the cartoon row? I told them we cannot mock or blaspheme Jesus in the same way, as we have MANY VERSES in the holy Quran about Virgin Mary and Jesus.We have achapter called Mary chaper
Who are our prophets? Jesus and Mohammed were simple people from the working class, close to the poor, and opposing the oppression and tyranny. They both saved their people through tolerance and love; they both adhere to the concept cooperation and unity; however extremists on both sides tarnished their teachings and drove the people away from the true path of their call.
The message of Jesus is love and purity of heart, and the message of Mohammed is mercy, let me here quote Matthew chapter 5, verse 4 in the holy Bible which Matthew says: " Blessed are the merciful: for they shall obtain mercy. Blessed are the pure in heart: for they shall see God". And, in Islam, the introductory verse, which we usually begin our speech, is "in the name of Allah, the most merciful, the most compassionate", here again the stress is mercy.the almighty Allah says about his prophet MUHAMMED “We sent you not save as a mercy for the peoples”.

History stood as a testament, to the tolerance of Muslims, with the Christians; upon the coming of AMIR IBN ELASS to Egypt, he ordered his army not to kill any Christians or even not to disturb the Egyptian monks who worship in mountains and valleys in remote places in Egypt. Up till now, we live together as Muslims and Christians in the land of Egypt, as brothers and sisters, celebrating the diversity as best as it can be on the land of Egypt.
What the objective of Islam?
Allah summarise His religion in one verse

(......................إن الله يأمر بالعدل والإحسان وإيتاء ذي القربى)

"Allah commands Justice, Al’ahsan (MEANS the doing of good meaning to be patient in performing Allah duties, totally for the sake of Allah and in accordance with the prophet’s traditions, and giving to kith and kin ,(first of all , your parents ,then your offspring, then your brothers and sisters, then your paternal uncles and aunts ,then maternal uncles and aunts) and, he forbids all indecent deeds (disobedience of parents, to tell lies ,to give false witness, to kill a life without a right) and evil and rebellion, He instructs you , that you may receive admonition
What are The basic beliefs of Muslims
The basic beliefs of Muslims fall into six main categories, which are known as the "Articles of Faith":
Faith in the unity of God
Faith in angels
Faith in all prophets
Faith in books of revelation
Faith in the last Day
Faith in divine decree

In Islam, faith and good works go hand-in-hand. A mere verbal declaration of faith is not enough, for belief in Allah makes obedience to Him a duty.
The Muslim concept of worship is very broad. Muslims consider everything they do in life to be an act of worship....., if it is done according to Allah's guidance.
There are also five formal acts of worship which help strengthen a Muslim's faith and obedience. They are often called the "Five Pillars of Islam."

Islam and Neighbourhood
The Noble Qur'an tells us that all of mankind is descended from one couple, Adam and Eve. Thus we are all brothers and sisters, and our differences in languages and colors are but a mercy that we might know one another. Language, religion and race should never be a reason for discriminating against people.
Islam teaches us to maintain good relations with all people ,A Muslim must be good to his neighbors, no matter their religion. The Prophet Muhammad (peace and blessings be upon him) taught us that a "neighbor" is not just the one next door but Your roommate at the dorm is your neighbor; the person sitting behind you or next to you in a bus or at a bus stop is your neighbor; the one sharing your office at work is your neighbor; the person enjoying fresh air next to you in a public garden is also a neighbor. You ought to treat all people kindly and socialize with them .
One of the prophet’s companions came to the Prophet Muhammad (peace and blessings be upon him) and said that he has recently purchased a house in a particular area and that his nearest person was such that he had no hope of any goodness from him and that he felt unsafe from his mischief. The Prophet Muhammad (peace and blessings be upon him) announced thrice: "He is not a believer whose neighbour is unsafe from his mischief."
It means that Muslims should wish for their neighbors what they wish for themselves. It means sharing their happiness and sorrow.

Last but not least, respectable guests, I would like to extend my hand in peace to every Christian here to begin a mutual cooperation and understanding. Interfaith sessions are worthy of attendance and worthy of participation and every participant here will sure cause a considerable change in (his or her) family, (his or her) friends, and even more important in (his or her) society.

I would like to salute the Saint Luke church and her respectable Reverend Barbara for the invitation which I hope will be the first in a process of cooperation between us and let me invite her and all the respectable guests to come to Ottawa mosque to give a lecture about Christianity and how to improve the bridges of mutual cooperation between the Muslims and the Christian in Ottawa.

لقد حرص الاسلام متمثلا في كتابه الكريم ونبيه الرحيم لا أقول في محاربة الإرهاب وإنما في معالجة أسبابه والقضاء على بذوره
أولا : نظرة سريعة على أسباب الغلو والذى عرف الآن باسم التطرف
إن الدافع الحقيقي وراء تطرف أوغلو أتباع أي دين مجموعة أسباب أهمها ما يلي
أولا- شدة العاطفة مع نقصان العلم وفقدان الضابط . فتجد الشاب مثلا محبا لدينه ....ويزداد الحب وتزداد العاطفة..... ويحركه الحب لتصورات خاطئة ....وتقوده التصورات لاتخاذ قرارات متطرفة ، ولنقص العلم بقواعد الدين يفتقد الضابط ...وأول ضحية لهذا الغلو هو الشخص نفسه فيبدا في تعذيب نفسه في ممارسة اعمال يظنها من القربات وتجاوزات يظنها طاعات .... وتحدث الطامة حين لا يجد المعلم والمربي الناصح ، فيحرص على فرض تصوره على الآخرين ... وحين لا يوجد من يفهمه ويحتويه ويرشده يبدأ الصراع ويظهر ما نعاني منه الآن من سفك دماء الأبرياء.
ولقد حدث هذا على عهد النبي ، فجاء ثلاثة من الشباب تدفعهم العاطفة والحب لهذا الدين وأرادوا أن يعرفوا المزيد من عبادات النبي ليطبقوها حبا في التقرب إلى الله ، فأُخبروا عن طريق النبي المعتدلة في التعبد فكأنهم تقالّوها ، وقالوا النبي غير محتاج لمزيد من التعبد لأنه مغفور له ما تقدم من ذنبه وما تأخر . وهنا يبدأ التصور الخاطئ المفتقر إلى العلم فيبدأ الغلو بظلم النفس كما ذكرنا .
فقال أحدهم سأصوم العمر كله ولن أفطر ، وقال الثاني وأنا سأعتزل النساء فلن أتزوج ، وقال الثالث أما أنا فسأصلى الليل كله ولن أنام . وهنا يخرج النبي صلى الله عليه وسلم فيزيدهم علما ويضع الضابط الشرعي فيقول (أما أنا فأقوم وأرقد ، واصوم وأفطر واتزوج النساء ... ثم يحسم النبي القضية فيقول مبينا طريق الاعتدال ومحذرا من الغلو ( .. فتلك سنتي فمن رغب عن سنتي فليس مني)
ثانيا - من أسباب الغلو فقدان الحرية والافتقار إلى مناخ الأخوة ، وديكتاتورية الآخرين. لأن فقدان الحرية يؤدي إلى إخفاء المشاعر والأحاسيس والأقوال والأفعال المخالفة للآخر فينشأعنها تراكم التصورات الخاطئة المتولّدة من أُحادية الرأي والإحساس بالظلم ، فيحاول الإنسان التعبير عن نفسه من خلال أفعال غريبة شاذة لا لشئ غير لفت الانظار والتعبير عن الذات !!!!
ولقد عالج القرآن هذه القضية علاجا حاسما،فإذا تدبرنا كلام ربنا وسنة نبينا فسنجد القرآن الكريم يضع قواعد ثابتة ومبادئ قاطعة وحاسمة في هذه المسألة، ليقطع المجال على المغالين من أتباعه من الفهم الخاطئ ، وليفسح المجال للحرية في الفكر والاعتقاد .
فيقول تعالى مبينا اعتراف الإسلام بحرية الاعتقاد (لكم دينكم ولي دين) (سورة الكافرون )
بل و يحافظ القرآن على اعتدال العاطفة عند أتباعه في حبهم إدخال الناس جميعا في هذا الدين ، فيبين قاعدة من أهم قواعد الدين المقوّمة للغلو وهى : ( لا إكراه في الدين ..)(سورة البقرة)حتى يمنعهم من تنامي عاطفة الحب لهذا الدين والحب للناس فتصل إلى درجة الغلو فيدفعهم إلى إجبارهم أو قسرهم على الدخول فيه، مؤكدا أنه لا إكراه لأحد في أن يدخل أو يعتنق هذا الدين ( ولو شاء ربك لآمن من في الأرض كلهم جميعا أفأنت تكره الناس حتى يكونوا مؤمنين )
ولقد دعى الإسلام والقرآن في كثير من آياته للتحاور وتقريب وجهات النظر وإشاعة روح الأخوة والتسامح لتقليل الفجوة بين الآخرين ولوأد التصورات الخاطئة في مهدها فعلى سبيل المثال لا الحصر قال تعالى (( قل ياأهل الكتاب تعالوا إلى كلمة سواء بيننا وبينكم ألا نعبد إلا الله ولا نشرك به شيئا ولا يتخذ بعضنا بعضا أربابا من دون الله فإن تولوا فقولوا اشهدوا بأنا مسلمين )آل عمران
بل و أمر الله سبحانه وتعالى نبيه صلى الله والمسلمين جميعا باتخاذ الحكمة والحسنى والمنهج العقلى الموضوعي في المجادلة والتناظر فقال (ولا تجادلوا أهل الكتاب إلا بالتي هى أحسن ..(العنكبوت 46) وذالك إشاعة لمبدأ الحريه وتأكيد على مبدأ التسامح مع الآخر
أما على الصعيد العملي فقد أصّل الإسلام قواعد في التعامل مع الآخرين في حالة السلم وفي حالة المخاصمة والحرب
ففي حالة السلم قال تعالى :
لا ينهاكم الله عن الذي لم يقاتلوكم في الدين ولم يخرجوكم من دياركم أن تبروهم وتقسطوا إليهم ..)سورة الممتحنة )
فلم يأمر الاسلام بحسن المعاملة بل طالب بالبروهي درجة أعمق في توطيد العلاقات الاجتماعية .فهو مزيد من التودد والتعاطف وإظهار البشاشة والود
وفي حالة الحرب والتى تمثل أقصى حالة التباعد والتنافر بين الأشخاص وفيها يتسابق كل طرف في الاستحواذ والسيطرة على الآخر ، بل والانتقام من الآخر وإيقاع أشد الأضرار والإيذاء به .
وفي حالة الحرب
يأتي الاسلام فيحرِّم على أتباعه إيذاء المسالم حتى ولو كان شابا قويا طالما لا يشترك في القتال !!! ويأتي الاسلام فيحرِّم إيذاء الشيخ المسن والمرأة والطفل ’ بل ويحافظ على البيئة فلا تقطع الأشجار ولا تحرق الأزهار ولا تهدم الكنائس ولا المعابد فيقول النبي :
(انطلقوا باسم الله و بالله و على ملة رسول الله لا تقتلوا شيخا فانيا و لا طفلا و لا صغيرا و لا امرأة و لا تغلوا و ضموا غنائمكم و أصلحوا و أحسنوا إن الله يحب المحسنين)
ولاحظ حرص النبي على ضبط العاطفة -- عاطفة الانتقام – وتذكيرهم بالاعتدال فيقول (..ولا تغلوا .!!!!) . ثم يأمرهم بالمبادرة بالصلح فإن كان لابد من الحرب فعليكم بالاحسان (و أصلحوا و أحسنوا إن الله يحب المحسنين) وهو أعلى درجات التسامح في أقصى نقطة تنافر وهي نقطة الحرب.

الزواج العرفي من منظور إسلامي

تمهيد
لقد انتشر الزنا في هذه الأيام في كثير من مجتمعاتنا ..!! لكنه بمسمى جديد ، وهو الزواج العرفي والذي يسميه البعض زواج آدم أو زواج الدم أو زواج (تيك أواي) ، والذي للأسف انتشر بين طلبة الجامعات ،لأسباب متعددة سوف نتعرض لها ، وأحب أن ألفت الإنتباه أن الزواج العرفي نوعان :
النوع الأول : وهو الذي توافرت فيه جميع أركان الزواج الصحيح من ولي وشهود وإيجاب وقبول ورضا بين الطرفين،غير أنه غير موثق رسميا في المحاكم ،لظروف خاصة فهذا لاخلاف بإباحته غير أن الأولى التوثيق .
النوع الثاني : هو ما يفتقد أركان الصحة كالولي أو الإشهاد إو الإعلان كهذا الذي انتشر بين طلبة الجامعات .وسوف نصطلح على تسميته الزواج العرفي المعاصر.
خطة البحث
وما يهمنا في هذه الدراسة هو النوع الثاني ، وسوف نتعرف بحول الله وقوته على أسبابه وبيان حكمه الشرعي ، ووسائل معالجته وسوف يكون بحثنا على النحو التالي :

المبحث الثاني : حكم الإشهاد على النكاح
المبحث الثالث : حكم نكاح السر
المبحث الرابع : الخلاصة والترجيح
المبحث الخامس: الخاتمة ( وسائل الوقاية والحد من انتشاره)
والله أسأل أن يبصّرنا بعيوبنا ، ويغفر لنا زللنا ، ويرحم علماؤنا ، ويهدي شبابنا ، ويحفظ أعراضنا ،ويصلح بناتنا ويهدي زوجاتنا. إنه ولي ذلك والقادر عليه اللهم آمين اللهم آمين
المبحث الأول :
تعريف الزواج العرفي
أولاً: تعريف "العرفي" لغة:
" العرفي " منسوب إلى العرف، والعرف في لغة العرب "العلم" تقول العرب عرفه يعرفه عرفة وعرفاناً ومعرفة واعترفا وعرفه الأمر: أعلمه إياه، وعرفه بيته: أعلمه بمكانه.
والتعريف : الإعلان، وتعارف القوم، عرف بعضهم بعضا، والمعروف ضد المنكر، والعرف:
ضد النكر".
ثانيا: تعريف "العرف" اصطلاحا:
يعرف عبد الوهاب خلاف (العرف): فيقول " هو ما تعارف عليه الناس وساروا عليه من قول أو فعل أو ترك ".
وهو قريب من تعريف الدكتور عبد العزيز الخياط، حيث يقول: "العرف اعتاده الناس، وساروا عليه في شؤون حياتهم".
ثالثاً: تعريف "الزواج العرفي:
عرفته مجلة البحوث الفقهية المعاصرة باعتباره علما على الزواج فقالت: "هو اصطلاح حديث يطلق على عقد الزواج غير الموثق بوثيقة رسمية، سواء أكان مكتوبة أو غير مكتوب ".
ويعرفه الدكتور عبد الفتاح عمرو فيقول: "هو عقد مستكمل لشروطه الشرعية إلا أنه لم يوثق، أي بدون وثيقة رسمية كانت أو عرفية".
ويعرفه الدكتور محمد فؤاد شاكر فيقول: "هو زواج يتم بين رجل وامرأة قد يكون قولياً مشتملا على إظهار الإيجاب والقبول بينهما في مجلس واحد وبشهادة الشهود وبولي وبصداق معلوم بينهما ولكن في الغالب يتم بدون إعلان، وإجراء العقد بهذه الطريقة صحيح ".
رابعاً: السبب في تسمية هذا الزواج بالعرفي:
مما سبق يتضح أن تسمية هذا الزواج بالزواج العرفي، يدل على أن هذا العقد اكتسب مسماه من كونه عرفاً اعتاد عليه أفراد المجتمع المسلم منذ عهد الرسول عليه الصلاة والسلام وصحابته الكرام، وما بعد ذلك من مراحل متعاقبة.
"فلم يكن المسلمون في يوم من الأيام يهتمون بتوثيق الزواج، ولم يكن ذلك يعني إليهم أي حرج، بل اطمأنت نفوسهم إليه. فصار عرفاً عُرف بالشرع وأقرهم عليه ولم يرده في أي وقت من الأوقات".
ولذلك يقول ابن تيمية: "ولا يفتقر تزويج الولي المرأة إلى حاكم باتفاق العلماء".
أما بالنسبة للتوثيق فإن ذلك لا يحدث خللاً في العقد، لأن الفقهاء جميعاً عندما عرفوا عقد الزواج لم يذكروا فيه التوثيق ولا الكتابة.
وإن كان التوثيق مهما جدا في هذه الأيام لضمان الحقوق، ولما شاع بين الناس من فساد الأخلاق وخراب الذمم.
ومن الملاحظ أن هذا هو تعريف النوع الأول ، أما النوع الثاني وهو من لم تتوفر فيه أركان النكاح أو شروط صحته ، وهذا هو مقصود بحثنا.أسباب انتشاره
حين نريد أن نحلل انتشار هذه الظاهرة وشيوعها سنجد أنها تنتشر بنسبة 95% بين مرحلة عمرية من عمر سبعة عشر عاما إلى عمر الثلاثين ؛ فهي تستحوذ على الشباب ؛وتتوزع هذه النسبة بين الخريجين وطلبة الجامعات وخاصة النظرية منهم (كالتجارة والآداب والحقوق ) وكذلك في المعاهد(كمعهد التعاون الزراعي ، ومعهد الخدمة الإجتماعية ومعهد اللاسلكي ، وغيرها )وكذلك الكليات العملية كالزراعة . وتتوزع نسبة لا يستهان بها بين طلبة المدارس الخاصة والمدارس الفنية .وليس ما ذكرناه على سبيل الحصر بل على سبيل المثال . وإلا فإن هناك نسبة بين الموظفات ورؤسائهن في العمل وخاصة بين الموظفات في مهنة السكرتارية .وبنظرة على هذه الفئات يتضح لنا هذه الأسباب:
1- الفراغ التعليمي فالكثير من طلبة الجامعات يعتمدن على ما يحدده الدكتور من أسئلة الإمتحانات أو الغش أو التخمين أو الحفظ السريع، لذا نجد أن النسبة الكبيرة من الزواج العرفي بين الكليات النظرية.
2- الاختلاط الذي يصل إلى حد المماسة والملاصقة كما يحدث في المدرجات ذات الكثافة الكبيرة ، أو في المعامل والمختبرات ، مما يولد إثارة العواطف وينتج عنه الإعجاب لينتهي بالوهم المزعوم الذي يسمونه الحب (ونحن لا ننكره..!! ولكن ليس بهذه الطريقة المعتمدة على الجسد والشهوة والإثارة)
3- التبرج الفاضح والتكشف المبتذل ، لدرجة أن كثيرا من الشباب المتدين يفضل البقاء في المنزل حتى يرحم نفسه من نار هذه الفتنة ، بل لقد اشتكى لي أستاذ جامعيا في كلية الزراعة من تحرجه الشديد وهو يشرح للطالبات بعض التجارب المعملية لأنهن حين ينظرن في المجهر ينكشف الكثير من صدورهن ....!!وكذالك طلبة المدارس الثانوية يشتكي الكثير منهن من تبرج المدرسات الذي يشغلهن عن متابعة الشرح لأنه مشغول بجسد المدرسة وقوامها الساحر ، وحركاتهن المظهرة لما فوق الركبة وما في الصدور..!!!!! ناهيك عن ملابس الطالبات وتزينهن في حرم الجامعة كأنها عروس ليلة زفافها بل أشد ..!والأمثلة كثيرة لكني أحكي من واقع ما يعرض علي في المسجد. وإلا فالأمر أسوأ مما نذكر .هذا فضلا عن الفيديو كليب والأفلام الهابطة التي تمثل 98% مما يعرض..
4- عدم النضج العقلي والعاطفي والانخداع بالمظاهر ، واللهث وراء الشهوة وهذا تجده بين طلبة المعاهد والدبلومات
5- الفقر وتأخر الزواج وعجز الشباب عن توفير تكلفة الزواج والمعيشة ؛ وهذا يفسر انتشاره بين الخريجين.
6- الجهل بأحكام الشريعة الإسلامية لأن معظم هذه الجامعات والمدارس يندر بل يكاد ينعدم فيها دراسة الشريعة الإسلامية ،وإن وجد فهو بأسلوب ممل.
7- الرفاهية المفرطة وعدم الإحساس بالمسئولية، لذا ينتشر بين المدارس الخاصة واللغات .ورجال الأعمال والنجوم .
8- التفكك الأسري أو غياب دور الأسرة التربوي والرقابي.
ونستطيع أن نضيف على هذه الأسباب السبب الرئيسي وهو الانحراف الإعلامي وغيبوبة الإعلام الهادف .وسوف نتناوله بشئ من التفصيل.

How does Islam give a woman half what a man gets in inheritance?

We came out of Ramadan with hearts full of faith, with minds full of conviction; we thank Allah for living to attend this wonderful spiritual experience which makes us fully pure, fully aware of Ramadan lessons.
One of many lessons, we learnt, is how to understand our religion, how to get the wisdom of our religion, how sweet and flexible is our religion.
We heard in Tarraweeh recitation many Quranic verses which explain and correct our understanding of Islam for example:
We learned from the chapter Elnisa’a. The rules of inheritance .This issue is often misunderstood in N. America. They wonder how Islam gives a woman half of what the man inherits. If men and women are equal in Islam, how does Islam give a woman half what man gets in inheritance.

When we study the rules of inheritance , we will conclude many facts : First, in thirty cases , a woman actually gets a share equal to a man’s share or even more.

For instance , When someone dies and leaves a daughter a wife and a father. The daughter will take a half of the whole Estate, the wife will take the one eighth
The father will inherit one quarter. He is a man ,a daughter is a woman .Islam is not concerned about whether you are a man or a woman . Islam concerned to the degree of closeness to the deceased.
Second, if we ponder over the cases in which man take more a woman we will find objectively that four cases only. For example , when a person dies and leaves a son and a daughter.the son will take double of his sister . the Question is why Look at the financial responsibilities a man has in a Muslim society. He should pay a dowry.

A woman will take a dowry from her husband. He has family expenses and family upkeep. She has not any obligatory financial responsibilities in her father’s house or in her husband’s house . she is voluntary spending.
